Abstract: El presente trabajo de investigación reconoce la técnica constitucional de las sentencias modulativas o atípicas que son emitidas por el máximo organismo de interpretación constitucional, la Corte Constitucional del Ecuador. Dicha técnica es utilizada al realizar el control de constitucionalidad de aquellas normas cuyo contenido adolece de vicios de constitucionalidad y que por consecuencia resultan contrarias a la Constitución y/o Tratados Internacionales de Derechos Humanos. Como consecuencia, al verificar dichos vicios, la Corte Constitucional deberá fundamentar y motivar sus resoluciones de forma que ordenen y adecuen el ordenamiento jurídico con el objeto de enaltecer la supremacía constitucional y garantizar el libre ejercicio de los derechos constitucionales en aras de evitar que sean expulsadas del ordenamiento jurídico. El problema de esta investigación radica en analizar si la Corte Constitucional en el uso de sus atribuciones y al emitir sentencias modulativas: (i) Ocupa el papel de legislador positivo al momento de adecuar el ordenamiento jurídico; y, (ii) Al modular el ordenamiento jurídico, mediante una sentencia constitucional podría transgredir el derecho a la seguridad jurídica.
Description: The present research paper recognizes the constitutional technique of modular or atypical judgements issued by the highest constitutional interpretation body, the Constitutional Court of Ecuador; this technique is used in the review of the constitutionality of those norms whose content presumes violations of constitutionality and which are therefore contrary to the Constitution and International Human Rights Treaties. As a consequence of the verification of that defect, The Constitutional Court shall base and motivate its problem in order to order and adapt the legal system in order to enhance constitutional supremacy and guarantee the free exercise of constitutional rights. The problem of this investigation lies when the Constitutional Court in the use of its powers: (i) Occupies the role of legislator when adapting the legal system; and, (ii) In modulating the legal system, by means of a constitutional ruling, it could violate the right to legal certainty.
