Abstract: Tax obligations, as established by the Tax Code, are a personal legal bond between the State or various tax creditor entities and the taxpayers or those responsible for such, which must be satisfied by means of a payment in cash, or may also be covered in kind or services in cash, once the generating event provided for by law has been verified. It’s necessary to evaluate whether the scenarios contemplated in the above rule regarding the expiration of the tax liability are all those that may occur in practice. It’ll be important in this research to define what the tax obligation is, how it is born, how it can be extinguished and, more importantly, how the obligations can expire. Since this research focuses particularly on the months in which Ecuador was in a "state of exception" due to public calamity, it is pertinent to analyze what provisions were included in those regulations and if in a certain way this affected the normal development of the Central Tax Administration. We will study the legal and administrative conditions under which the tax institution of forfeiture behaved in times of pandemic. Gathering the Executive Decrees, resolutions, as well as constitutional and judicial decisions, which were most relevant to the state of health emergency in Ecuador, will allow us to verify whether the application of Art. 94 of the Tax Code was valid or whether there were prohibitions that provided that this figure was not operative. In order to understand the behavior and development of the expiration of tax obligations, it will be vital to determine what the conditions of these and other tax institutions were before the arrival of COVID 19 to our territory. We will investigate whether the lapse of time was clear for the active subject and the subjects of the tax relationship or whether it gave rise to problems of confusion, error in its application or its effects. The legal institutions that we will have to expose are several, but this does not mean that there will be a dozen of them. In fact, we will discuss one in particular as we said before, but it will be necessary to synthesize other institutions, which are closely related to the forfeiture in order to have a complete vision of how tax obligations are developed in our legislation. Understanding how expiration operates and the conditions that must be met in order for it to be declared, is the purpose of the work presented today, which will help both the Central Administration and the taxpayers to comply with their duties and demand their rights. In such a way that, the casuistry of the application of these institutions, as well as the one issued due to the adverse sanitary circumstances added to the current regulations, a greater control and vigilance on the obligations of the Administration and on the rights that are enforceable on the part of the taxpayers will be applied.
Description: Las obligaciones tributarias, tal y como lo establece el Código Tributario es un vínculo jurídico personal que concurre entre el Estado o diversas entidades acreedoras de tributos y los contribuyentes o responsables de aquellos, para lo cual se debe satisfacer mediante una prestación en dinero, o también puede ser cubierta en especies o servicios apreciables en dinero, una vez que se ha verificado el hecho generador previsto en la ley. Es necesario evaluar si los escenarios que contempla la norma ut supra respecto a la caducidad de la obligación tributaria, son todos los que pueden llegar a darse en la práctica. Será importante en la presente investigación definir qué es la obligación tributaria, como nace, como esta puede llegar a extinguirse y de manera más superlativa como las obligaciones pueden llegar a caducar. En vista de que esta investigación focaliza de manera particular los meses en los que el Ecuador se encontraba en “estado de excepción” por calamidad pública es pertinente analizar que disposiciones se incluyeron en aquella normativa y si de cierta manera esta afectada al desarrollo normal de la gestión Tributaria Central. Nos encaminaremos a estudiar las condiciones jurídicas y administrativas en las que la institución tributaria de caducidad se comportó en época de pandemia. Recabar los Decretos Ejecutivos, resoluciones, así como las decisiones constitucionales y judiciales, que imprimieron mayor relevancia en torno al estado de emergencia sanitaria en el Ecuador, permitirá comprobar si la aplicación del Art. 94 del Código Tributario era válido o a su vez existían prohibiciones que disponían que esta figura no se encontraba operativa. Para entender el comportamiento y desarrollo que ha tenido la caducidad de las obligaciones tributarias será vital precisar cuáles eran las condiciones de estas y otras instituciones tributarias antes de la llegada del COVID 19 a nuestro territorio. Vamos a indagar si la caducidad estaba clara para el sujeto activo y los sujetos de la relación tributaria o si de ella devenían problemas de confusión, error en su aplicación o sus efectos. Las instituciones jurídicas que deberemos exponer son varias sin que eso signifique que serán una decena de ellas. En realidad discutiremos de una en particular como ya lo dijimos anteriormente, pero habrá que sintetizar otras instituciones, que guarda estrecha relación con la caducidad para tener una visión completa de cómo se desarrollan las obligaciones tributarias en nuestra legislación. Comprender como opera la caducidad y las condiciones que tienen que darse para que esta sea declarada son el talante del trabajo hoy presentado y que servirá para que tanto, la Administración Central como para los contribuyentes cumplan con sus deberes y exijan sus derechos. De tal manera que, la casuística de la aplicación de estas instituciones, como de la expedida en razón de las circunstancias sanitarias adversas sumado a la normativa vigente se aplique un mayor control y vigilancia sobre las obligaciones de la Administración y sobre los derechos que son exigibles de parte de los contribuyentes.
