Abstract: Dentro del simple devenir de la vida humana, registrada por la Historia desde hace seis mil años, cuando la invención de la escritura marcó la distinción entre la prehistoria y la historia propiamente dicha, las épocas o edades en que ésta se divide, están delimitadas por hechos trascendentales que muestran los cambios profundos que se producen en el mundo y que justifican hablar de que la humanidad vive otra época. El protagonista de ese cambio es el ser humano cuyo variado actuar se ve vinculado, permanentemente, a descubrimientos de carácter científico y tecnológico que dan lugar a nuevas formas de vida comunitaria, como lo hicieron a su tiempo la invención de la brújula, la pólvora o la imprenta, en la transición de la Edad Media a la Moderna, por ejemplo; o las naves espaciales, los satélites para la comunicación o el espionaje, las armas nucleares y el genoma humano, en el tránsito al que asistimos, casi sin darnos cuenta, desde la Época Contemporánea que vivíamos pocas décadas atrás, hasta la nueva era actual, que aún no cuenta con una denominación, pero que ya existe. Los países miembros de la “Organización del Convenio Andrés Bello de integración educativa, científica, tecnológica y cultural”, no han sido ajenos a estos propósitos, tal como se refleja en la valiosa y abundante normatividad adoptada para el fomento de la Ciencia y la Tecnología, la Educación y la Cultura; en la organización institucional que debe darles su soporte; en el otorgamiento de facilidades y estímulos a los investigadores que a esas tareas se dedican; en la satisfactoria promoción practicada respecto de la participación conjunta del sector productivo, la comunidad científica y los centros de investigación como las Universidades, para la toma de decisiones; en el aporte de recursos para la ejecución de actividades científicas y tecnológicas. Deseoso de profundizar en el conocimiento de los logros obtenidos en este campo por los países suscriptores del Convenio, de analizar sus enfoques y contenidos, y de avizorar su futuro, he decidido abordar el tema, a través de la presente Tesis, buscando determinar tanto las analogías como las diferencias que presentan las respectivas legislaciones de dichos países, mediante un estudio individualizado de las mismas y la práctica de un análisis comparativo en las materias antes enunciadas y en otras que de ellas se derivan, tales como el tratamiento constitucional y legal otorgado a la Ciencia y a la Tecnología, los instrumentos de coordinación, la planeación, la participación, la regionalización, la financiación, así como los incentivos tributarios otorgados a quienes dedican su capacidad, esfuerzo, tiempo y recursos, a las actividades científicas y tecnológica.
Within the simple evolution of human life, recorded by History for six thousand years, when the invention of writing marked the distinction between prehistory and history proper, the epochs or ages in which it is divided, are delimited by transcendental events that show the profound changes that occur in the world and justify talking about humanity living in another era. The protagonist of this change is the human being whose varied action is permanently linked to discoveries of a scientific and technological nature that give rise to new forms of community life, as did the invention of the compass, gunpowder or the printing press, in the transition from the Middle Ages to the Modern Age, for example; or the spaceships, the satellites for communication or espionage, nuclear weapons and the human genome, in the transit we are witnessing, almost without realizing, from the Contemporary Era that we lived a few decades ago, to the current new era, that still does not have a denomination, but that already exists. The member countries of the "Andrés Bello Convention Organization of educational, scientific, technological and cultural integration" have not been alien to these purposes, as reflected in the valuable and abundant regulations adopted for the promotion of Science and Technology , Education and Culture; in the institutional organization that should give them their support; in the granting of facilities and incentives to the researchers who dedicate themselves to those tasks; in the satisfactory promotion practiced regarding the joint participation of the productive sector, the scientific community and the research centers like the Universities, for the decision making; in the contribution of resources for the execution of scientific and technological activities. Eager to deepen the knowledge of the achievements in this field by the countries subscribing to the Convention, to analyze their approaches and contents, and to envision their future, I have decided to address the issue, through this thesis, seeking to determine both the analogies such as the differences presented by the respective legislations of these countries, through an individualized study of them and the practice of a comparative analysis in the matters mentioned above and in others that derive from them, such as the constitutional and legal treatment granted to Science and Technology, the instruments of coordination, planning, participation, regionalization, financing, as well as the tax incentives granted to those who dedicate their capacity, effort, time and resources to scientific and technological activities.
