Abstract: El presente estudio sobre el Régimen Tributario vigente en el Ecuador, aspira a constituirse en un aporte al conocimiento actualizado de la normatividad existente sobre esta temática y sus repercusiones en la economía del país. Todo Estado moderno requiere disponer de un marco adecuado para obtener los recursos monetarios necesarios y suficientes para financiar su funcionamiento administrativo y la obra pública, así como para desarrollar programas en todos los ámbitos de su accionar. Por esto la gestión tributaria para asegurar la recaudación de las rentas provenientes de los distintos estamentos de la sociedad, tanto a nivel individual como institucional, se convierte en el instrumento clave para su propia existencia; de allí que la presente investigación aborda cuatro grandes capítulos que cubren todo el ámbito de la temática y entrega elementos para su análisis y enriquecimiento. En el primer capítulo se aborda el Régimen Tributario en el Ecuador. Se estudian los principios tributarios: el de legalidad, igualdad, generalidad y proporcionalidad: analizan los ingresos tributarios, los órganos encargados de la administración tributaria en el Ecuador y los impuestos directos e indirectos. El segundo capítulo centra su reflexión y análisis en torno a las recaudaciones tributarias, principalmente el Impuesto a la Renta y el Impuesto al Valor Agregado. En cada uno de ellos se estudia el concepto, su objeto y naturaleza, las características, su estructura, normatividad, aplicación, etc. El tercer capítulo abarca el tratamiento de las principales reformas que han sido formuladas y aplicadas en distintos gobiernos y desde distintos intereses, en las leyes e instituciones encargadas de aplicar la recaudación de impuestos. Incluye este capítulo elementos que ayudan a comprender la actual normatividad en el marco de la dolarización. El cuarto capítulo trata de ser un soporte al estudio y comprensión del rendimiento tributario, esto es, aquí se evalúa la eficacia de la política tributaria del país y deja entrever las falencias y éxitos logrados en su aplicación, es decir en la recaudación de los impuestos. El estudio se centra en el análisis de la evolución e impacto del IVA en la economía ecuatoriana y las brechas y porcentajes de evasión del IVA. Es indiscutible que la consecución de mayores recursos fiscales está en relación directa con la existencia de un organismo impositivo eficaz; se puede afirmar, sin riesgo a equivocaciones, que en los últimos quince años en el país se han dado pasos definitivos, quizá estructurales, en esta dirección. Todo el actual sistema tributario se ha ido modernizando en la Región Andina y en otros países, con el apoyo de organismos internacionales.
Description: The present study on the Tax Regime in force in the Ecuador, aspires to be a contribution to knowledge update of the existing regulations on this subject and their repercussions on the country's economy. Every modern state requires an adequate framework to obtain the necessary and sufficient monetary resources to finance its administrative functioning and public works, as well as to develop programs in all areas of its actuate. For this reason, tax management to ensure collection of the income from the different estates of society, both at the individual and institutional levels, it becomes the key instrument for its own existence; of there that the present investigation addresses four major chapters that cover the whole scope of the theme and delivers elements for its analysis and enrichment. The first chapter deals with the Tax Regime in the Ecuador. The tax principles are studied: legality, equality, generality and proportionality: analyze income tributaries, the bodies in charge of the tax administration in Ecuador and direct and indirect taxes. The second chapter focuses its reflection and analysis around the tax collections, mainly the Income Tax and the Value Added Tax. In each one of them, the concept, its object and nature, characteristics, structure, normativity, application, etc. The third chapter covers the treatment of the main reforms that have been formulated and applied in different governments and from different interests, in the laws and institutions in charge to apply the collection of taxes. Includes this chapter elements that help to understand the current regulations in the dollarization framework. The fourth chapter tries to be a support to the study and understanding tax efficiency, that is, here the effectiveness of the tax policy of the country and lets glimpse the shortcomings and successes achieved in its application, that is, in the collection of taxes. The study focuses on the analysis of the evolution impact of VAT on the Ecuadorian economy and the gaps and percentages of VAT evasion. It is indisputable that the achievement of greater fiscal resources is in direct relation to the existence of an organism effective tax; it can be affirmed, without risk of mistakes, that in the last fifteen years in the country steps have been taken definitive, perhaps structural, in this direction.
