La responsabilidad penal de las personas Jurídicas : un análisis doctrinario

Abstract

La responsabilidad penal es uno de los elementos que a cabalidad debe ser verificado en estricto derecho por el juzgador en nuestro caso el Tribunal Penal, para la imposición de la pena y es claro de que no comprobarse la infracción no puede haber responsabilidad. La responsabilidad penal antes de Savigny se lo podía aplicar tanto a la persona natural como jurídica, llegando inclusive a darse sanciones papales a las ciudades o municipios mediante el uso de interdictos. Es Savigny y su teoría de la Ficción quien rompe el esquema de responsabilidad penal de sanción a la persona moral y en enfocándose solamente en la persona natural. Por otro lado y contrario a Savigny y su teoría, tenemos a Gierke y teoría de la Realidad que manifiesta que una persona jurídica o moral tiene su propia voluntad distinta de las personas naturales que la integran y que es factible responsabilidad penal. Y bajo el esquema y teoría de la Realidad de Gierke es que se crean tipos penales para la persona jurídica.

And under the scheme and theory of Gierke's Reality is that criminal offenses are created for legal person.
