Repercusiones de la lucha contra el terrorismo en el derecho internacional humanitario y en el derecho internacional de los derechos humanos

Abstract

El objetivo principal de la presente investigación fue el de analizar las repercusiones de la lucha contra el terrorismo en el derecho internacional humanitario y en el derecho internacional de los derechos humanos. El presente trabajo doctoral, parte de las siguientes hipótesis: a) las medidas antiterroristas pueden implicar un mayor peligro para las normas democráticas y libertades fundamentales, de lo que es la propia violencia terrorista; y, b) la normativa jurídica de Derecho Internacional Humanitario, permite combatir este flagelo o si es necesario su inmediata reforma para hacer frente al fenómeno terrorista. Para dar respuesta a estos planteamientos, se analizará en esta tesis doctoral, el terrorismo internacional contemporáneo en el contexto del Derecho, la normativa vigente sobre terrorismo y la aportación de los organismos internacionales en contra del terrorismo, las normas y principios del Derecho Internacional en materia de Derechos Humanos y del Derecho Internacional Humanitario aplicables a las situaciones de terrorismo. Además, investigaremos las medidas que han adoptado los Estados en la “lucha contra el terrorismo” para determinar si éstas se enmarcan en lo que establece la normativa internacional vigente Asimismo, analizaremos si la obligación de los Estados de garantizar la seguridad de sus ciudadanos podría superponerse a la obligación de cumplir con las normas de Derecho Internacional Humanitario y de los Derechos Humanos. Así esta tesis doctoral será un soporte académico y de consulta, ya que pretende responder a una serie de inquietudes en el campo jurídico sobre el fenómeno terrorista y sus implicaciones en Derecho Internacional, especialmente en el Derecho Internacional Humanitario y en el Derecho Internacional de los Derechos Humanos

The main objective of the present investigation was to analyze the repercussions of the fight against terrorism in international humanitarian law and in the international law of human rights. The present doctoral work, part of the following hypotheses: a) counter-terrorism measures may involve a greater danger to democratic norms and fundamental freedoms, of what is proper terrorist violence; and, b) the legal regulations of International Humanitarian Law, allows to combat this scourge or if it is necessary its immediate reform to face the terrorist phenomenon. In order to respond to these proposals, this doctoral thesis will be analyzed, contemporary international terrorism in the context of law, regulations on terrorism and the contribution of international organizations against the terrorism, the norms and principles of International Law on Human Rights Human Rights and International Humanitarian Law applicable to situations of terrorism. In addition, we will investigate the measures adopted by States in the "Fight against terrorism" to determine if these are framed in what the current international regulations. We will also analyze whether the obligation of the States to ensure the safety of its citizens could be superimposed on the obligation of comply with the rules of International Humanitarian Law and Rights Humans. Thus, this doctoral thesis will be an academic and consultation support, as it aims to respond to a series of concerns in the legal field about the terrorist phenomenon and its implications in International Law, especially in International Law Humanitarian and in the International Law of Human Rights
