Abstract: Ocurrió hace algún tiempo y en territorio extranjero que un renombrado delincuente, Alcapone, utilizaba técnicas tan imperceptibles que las autoridades no llegaban a establecer su responsabilidad en los actos ilícitos cometidos. Sin embargo, la justicia logró tener motivos para iniciar un proceso penal en su contra, por la verificación de la Administración Tributaria, de eminente perjuicio fiscal causado por el agente. Podría ser el Ecuador un lugar donde la política tributaria sea, no solo herramienta fiscal, sino también un mecanismo de soporte en las demás áreas administrativas? Qué pasó con el caso de ciertos banqueros que además de perjudicar a los depositantes, configuraron el delito tributario de defraudación, por retención indebida de valores del Estado? Qué pasa con ciertos políticos, para los cuales la norma tributaria no es aplicable? Se evidencia que la verificación del fenómeno penal tributario no puede ser llevado a cabo desatendiendo la realidad penal y la tributaria, debido a que se pueden llegar a concebir valoraciones jurídicas penales sobre figuras aparentes que producen discrepancias interpretativas que incluso impiden una garantía efectiva del debido proceso y, en la mayoría de los casos, desembocan en impunidad. Así, se debe tomar en consideración que el derecho penal, en toda su expresión, está, en gran medida, subordinado al ordenamiento y a la sustancia tributaria para verificar y sancionar las infracciones tributarias y, a su vez, el derecho penal tributario está sometido al procedimiento penal común y los principios que lo rigen. Es lógico suponer entonces que todas las ramas del derecho tengan entre sí vinculaciones más o menos estrechas, aun cuando hayan desarrollado ampliamente sus propios principios y conceptos. Ningún derecho forma un sistema aislado y totalmente autónomo; al contrario, es parte de un sistema que se integra armónicamente. Por tanto, estas ramas jurídicas no pueden actuar en escenarios diferentes, sino que, para concretar un eficaz ordenamiento y una proyección de seguridad jurídica, deben evolucionar y adaptarse de forma paralela, para evitar que ocurran sucesos como los indicados. Por esto, las figuras penales tributarias deben ser objeto de constante cambio, como consecuencia de un sistema tributario en el cual la evasión es su más notoria y a la vez funesta característica, que debe determinar que autoridades fiscales u legisladores busquen, para solucionar el problema, reformas frecuentes que, desafortunadamente, no ha sido ni abatida ni atenuada. Eduardo Couture, de una manera muy precisa y ligera señala que el derecho se transforma constantemente y que se debe seguir sus pasos. Este en este sentido donde se desencadenan las inquietudes a ser resueltas: Al ser el derecho penal tributario, un derecho penal especial, ¿la modificación en sus normas adjetivas debió ser contemplada en esta rama? ¿en qué grado influye en la eficacia normativa penal tributaria el conservar figuras en desuso? ¿De qué manera ha interferido esta falta de adecuación en la aplicación de las normas especiales?. De ser el caso, ¿ qué soluciones se pueden plantear para impulsar la aplicación debida de la normativa penal tributaria? Por los motivos expuestos, en la presenta se pretende: detectar las inconsistencias que presenta la normativa penal tributaria ante las variaciones que han afectado normativas indirectamente influyentes en ella; determinar el riesgo que implica la falta de adecuación de la norma específica frente a variaciones de la legislación primaria; y, analizar las figuras penales tributarias que, por la inadecuación oportuna, han llegado a convertirse en instituciones absoletas e inaplicables, que crean paraísos fiscales para determinados grupos sociales.
It happened some time ago and in foreign territory that a renowned criminal, Alcapone, used techniques so imperceptible that the authorities did not come to establish their responsibility in the illicit acts committed. However, the justice managed to have grounds to initiate a criminal proceeding against him, for the verification of the Tax Administration, of eminent fiscal damage caused by the agent. Could Ecuador be a place where tax policy is not only a fiscal tool, but also a support mechanism in other administrative areas? What happened to the case of certain bankers that in addition to harming the depositors, configured the tax offense of fraud, for undue retention of State securities? What happens to certain politicians, for whom the tax rule is not applicable? It is evident that the verification of the tax criminal phenomenon can not be carried out by neglecting the penal and tax reality, because criminal legal valuations can be conceived on apparent figures that produce interpretative discrepancies that even impede an effective guarantee of due process and, in most cases, they end in impunity. Thus, it should be taken into consideration that criminal law, in all its expression, is, to a large extent, subordinate to the law and the tax substance to verify and sanction tax infractions and, in turn, the tax criminal law is subject to common criminal procedure and the principles that govern it. It is logical to suppose then that all branches of law have more or less close links with each other, even if they have developed widely their own principles and concepts. No right forms an isolated and totally autonomous system; on the contrary, it is part of a system that is integrated harmonically. Therefore, these legal branches can not act in different scenarios, but, in order to specify an effective ordering and a projection of legal security, they must evolve and adapt in parallel, to avoid the occurrence of events such as those indicated. For this reason, the tax criminal figures must be subject to constant change, as a consequence of a tax system in which evasion is its most notorious and at the same time dismal characteristic, which must determine which fiscal authorities or legislators seek, in order to solve the problem, frequent reforms that, unfortunately, have not been reduced or mitigated. Eduardo Couture, in a very precise and light way, points out that the law is constantly changing and that he must follow in his footsteps. This in this sense where the concerns are unleashed to be resolved: As the tax criminal law, a special criminal law, the modification in its adjective rules should be contemplated in this branch? To what degree does the tax penal normative effectiveness influence the conservation of disused figures? How has this lack of adequacy in the application of special rules interfered? If this is the case, what solutions can be proposed to promote the proper application of tax regulations? For the above reasons, the presentation aims to: detect the inconsistencies that the tax criminal law presents in the face of the variations that have affected indirectly influential regulations in it; determine the risk implied by the lack of adequacy of the specific rule against variations in primary legislation; and, analyze the tax penal figures that, due to the opportune inadequacy, have become obsolescent and inapplicable institutions, which create tax havens for certain social groups.
