Abstract: | ¿Mediante los Mandatos Constituyentes Nª 1,2 4 y 8 emitidos por la Asamblea Nacional Constuyente de Montecristi se restringieron lo "derechos adquiridos" de los grupos sindicales, fruto de grandes luchas y conquistas sindicales o por medio de los mencionados Mandatos se logró erradicar ciertas "remuneraciones de desmesuradas y privilegios excesivos" que atentaban contra los intereses del Estado? Para responder esta interrogante hemos realizado sucinto recorrido por los principales acontecimientos suscitados en los ámbitos, social, político y económico en Ecuador desde la década de los noventa, hemos analizado: cada uno de los Mandatos referidos con anterioridad; la Resolución a la demanda de declaratoria de inconstitucionalidad emitida, por el Pleno del Tribunal Constitucional de la República del Ecuador en el año 2008: la queja de organizaciones sindicales ecuatorianas ante la OIT en el año 2010; así como también la revisión de dos contratos colectivos, uno antes y otro después de la aplicación de los Mandatos Constituyentes, con el fin de puntualizar cuáles fueron las limitaciones a la contratación colectiva pública y las restricciones a la sindicalización ecuatoriana. Through Constituent Mandates No. 1.2 4 and 8 issued by the Constituent National Assembly of Montecristi, the "acquired rights" of the trade union groups were restricted, as a result of great union struggles and conquests, or through the aforementioned Mandates, it was possible to eradicate certain "Excessive remunerations and excessive privileges" that threatened the interests of the State? To answer this question we have made a brief tour of the main events that have taken place in the social, political and economic spheres in Ecuador since the nineties, we have analyzed: each of the Mandates referred to above; the Resolution to the demand for the declaration of unconstitutionality issued by the Plenary of the Constitutional Court of the Republic of Ecuador in 2008: the complaint of Ecuadorian trade union organizations before the ILO in 2010; as well as the review of two collective agreements, one before and the other after the application of the Constituent Mandates, in order to clarify what were the limitations to public collective contracting and the restrictions on Ecuadorian unionization. |
