El anatocismo como una figura ilegal en el ámbito económico-financiero dentro de la legislación ecuatoriana

Abstract

El anatocismo constituye una figura ilegal en el ámbito económico financiero dentro de la legislación ecuatoriana, esta prohibición, que ya se contempló años atrás en el Derecho Romano, así quien adquiere una obligación por la contratación de un préstamo se obliga con acreedor a devolver el valor total del crédito, más los intereses legales que se generan sobre el mismo; y asu vez el acreedor se obliga, para con el deudor, a cobrar lo justo. No se puede pactar intereses superiores a los legalmente establecidos, y tampoco se pueden cobrar intereses sobre interes.
