Abstract: Hoy en día en la aplicación de leyes de tránsito complementarias en la parte procesal con el código de procedimiento penal juegan un papel trascendental en el procedimiento a seguirse en los delitos flagrantes de tránsito es por ello que debe existir una adecuada reestructuración en cuanto al sistema de aplicación del trámite de flagrancia en materia de transito. La Ley Orgánica de Transporte Terrestre, Tránsito y Seguridad Vial que se encuentra vigente desde el 7 de agosto del 2008, incorporó grandes cambios en la materia de tránsito y seguridad vial, reafirmando que la sustanciación en los procesos penales por delitos flagrantes de tránsito se llevaría a cabo mediante el sistema oral, en concordancia con la Constitución y el Código de Procedimiento Penal. A pesar de dicha implementación e innovación en la normativa penal que abarca esta rama del Derecho Penal; en la práctica no se evidenciaba una transformación real, por lo que, con el objetivo de superar las constantes trabas reflejadas en el desarrollo del proceso penal en el cometimiento de delitos flagrantes en materia de tránsito y para cumplir y hacer cumplir a cabalidad con los derechos y garantías constitucionales y del debido proceso, el Estado a través del Consejo Nacional de Judicatura, reestructuró es sistema operativo para la aplicación del procedimiento en los procesos penales por delitos flagrantes de tránsito implementando un nuevo modelo de gestión tendiente a lograr celeridad y justicia para las víctimas de estas infracciones.
Today in the application of complementary traffic laws in the procedural part with the code of criminal procedure play a transcendental role in the procedure to be followed in flagrant crimes of transit is why there must be an adequate restructuring in terms of the system of application of the procedure of flagrancy in the matter of transit. The Organic Law of Land Transportation, Traffic and Road Safety, which has been in force since August 7, 2008, incorporated major changes in the matter of traffic and road safety, reaffirming that the substantiation in criminal proceedings for flagrant crimes of transit would be carried out performed through the oral system, in accordance with the Constitution and the Code of Criminal Procedure. In spite of this implementation and innovation in the penal regulations that this branch of Criminal Law covers; in practice, no real transformation was evident, so that, with the aim of overcoming the constant obstacles reflected in the development of the criminal process in the commission of flagrant crimes in the matter of transit and to comply and fully enforce the rights and constitutional guarantees and due process, the State through the National Council of Judicature, restructured the operating system for the application of the procedure in criminal proceedings for flagrant crimes of transit implementing a new management model aimed at achieving speed and justice for the victims of these infractions.
