Abstract: Este trabajo investigativo tiene por objetivo el análisis de la normativa jurídica del Código Orgánico General de Procesos que rige para las diligencias preparatorias y la declaración de parte como título ejecutivo, así como en la valoración de los criterios de tratadistas sobre lo que es materia de la investigación, de tal manera que podamos profundizar la problemática social planteada para el desarrollo de una propuesta que viabilice a la solución del problema a investigar. Por lo que, la presente investigación se dividirá en 4 capítulos. El primer capítulo se encuentra orientado a buscar la identificación y formulación del problema, así como los objetivos que busca la investigación y su justificación en listando los principios aplicables en esta rama del derecho. Dentro del capítulo 2 analizaremos y desarrollaremos de forma más concreta los conceptos de Títulos Ejecutivos su clasificación, generalidades requisitos, naturaleza jurídica clasificación para lo cual se utilizará no solamente doctrina sino nuestra normativa vigente. En el tercer capítulo tenemos el desarrollo de las diligencias preparatorias de igual forma se establece su naturaleza jurídica, requisitos, clasificación. Se desarrolla además la declaración de parte como diligencia preparatoria y finalmente terminamos este capítulo realizando un análisis de derecho comparado uruguayo y chileno. En el capítulo 4 que es el último capítulo, desarrollaremos la propuesta de la investigación que es la realización de un anteproyecto de Ley reformatoria al Código Orgánico General de Procesos.
Description: This investigative work aims to analyze the legal regulations of the General Organic Code of Processes that governs the preparatory proceedings and the declaration of a party as an executive title, as well as in the evaluation of the criteria of writers on what is the subject of the research, in such a way that we can deepen the social problems raised for the development of a proposal that makes possible the solution of the problem to be investigated. Therefore, this research will be divided into 4 chapters. The first chapter is oriented to seek the identification and formulation of the problem, as well as the objectives that the research seeks and its justification in listing the applicable principles in this branch of law. Within chapter 2 we will analyze and develop in a more concrete way the concepts of Executive Titles, their classification, general requirements, legal nature, classification for which not only doctrine but also our current regulations will be used. In the third chapter we have the development of the preparatory proceedings in the same way its legal nature, requirements, classification is established. The declaration of the party is also developed as a preparatory diligence and finally we finish this chapter by conducting an analysis of Uruguayan and Chilean comparative law. In chapter 4, which is the last chapter, we will develop the research proposal that is the realization of a preliminary reform law to the general organic code of processes.
