| Abstract: | El presente trabajo de investigación tiene como objetivo analizar la gran importancia en el tema de garantías jurisdiccionales de Control Constitucional, Derechos fundamentales, protección inmediata y de directa aplicación a los derechos Constitucionales, todo aquello se ha concentrado para evitar la violación de derechos consagrados en la Constitución, con el fin de garantizar la supremacía constitucional haciendo respetar los derechos consagrados en la norma suprema. La presente investigación dividirá en tres capítulos. El primer capítulo hablaremos sobre el derecho a lactancia, definiciones según los instrumentos Internacionales, OMS, Constitución de la República del Ecuador. De igual forma el segundo capítulo analizaremos la acción pública de inconstitucionalidad y Control Constitucional y sus efectos. Finalmente, en el tercer capítulo hablaremos sobre la interpretación Constitucional, junto con el análisis de la sentencia No. 36-19-IN/21, que analiza el derecho a la lactancia en el sector privado basándose en las acciones de defensa, de la tutela judicial efectiva, seguridad jurídica. |
| Description: | The objective of this research work is to analyze the great importance in the subject of jurisdictional guarantees of Constitutional Control, Fundamental Rights, immediate protection and direct application to Constitutional rights, everything that has been concentrated to avoid the violation of rights enshrined in the Constitution, in order to guarantee constitutional supremacy by enforcing the rights enshrined in the supreme norm. This research will be divided into three chapters. The first chapter will talk about the right to breastfeed, definitions according to international instruments, WHO, Constitution of the Republic of Ecuador. In the same way, the second chapter will analyze the public action of unconstitutionality and Constitutional Control and its effects. Finally, in the third chapter we will talk about the Constitutional interpretation, together with the analysis of judgment No. 36-19-IN/21, which analyzes the right to breastfeed in the private sector based on defense actions, guardianship effective judicial, legal certainty. |
