Abstract: Actualmente la tecnología transversaliza toda la dinámica social, por ende, surgen nuevas problemáticas alrededor de ella, las mismas que deben ser reguladas, tanto a nivel normativo, como concientizadas a nivel social. Esta investigación se centra en el estudio del “sexting” secundario como una forma de vulneración directa derechos humanos, garantizados en la legislación ecuatoriana. El estudio se realizó a través del método deductivo. Se parte con afirmaciones de carácter general, empezando por la definición del “sexting” como un fenómeno actual, en donde se recopilará información que permitirá adentrarse a la problemática que se genera a nivel jurídico, y social. La investigación a su vez estará basada en doctrina, en el análisis de normas jurídicas relevantes estipuladas en la legislación nacional y sobre todo contendrá un análisis jurídico comparado con jurisprudencia vinculante, que permita comprender la importancia de este fenómeno y el cómo afecta de una manera intrínseca los derechos de los individuos que han sido víctimas en estos casos. Para contrarrestar la problemática de la investigación se inicia con la siguiente hipótesis: El “sexting” secundario vulnera derechos humanos fundamentales consagrados en la legislación doméstica ecuatoriana y también consagrados en documentos internacionales.
Description: Currently, technology cuts across all social dynamics, therefore, new problems arise around it, the same ones that must be regulated, both at the regulatory level, and at the social level. This research focuses on the study of secondary "sexting" as a form of direct violation of human rights, guaranteed in Ecuadorian law. The study was carried out through the deductive method. It starts with statements of a general nature, beginning with the definition of "sexting" as a current phenomenon, where information will be collected that will allow us to delve into the problems that are generated at a legal and social level. The research, in turn, will be based on doctrine, on the analysis of relevant legal norms stipulated in national legislation and, above all, will contain a legal analysis compared to binding jurisprudence, which will allow us to understand the importance of this phenomenon and how it affects in an intrinsic way the rights of the individuals who have been victims in these cases. To counteract the problem of the investigation, it begins with the following hypothesis: Secondary "sexting" violates fundamental human rights enshrined in Ecuadorian domestic legislation and also enshrined in international documents.
