Abstract: The objective of this investigation was to know if the psychologist experts accredited by the Judicial Council of the Province of Loja apply the recommended and standardized good practices within the field of forensic psychology, strengths and weaknesses in the work of the forensic psychologist will be analyzed. , the causes for which good practices are not applied and the incidence of this fact on the quality of the experts carried out will be determined to finally socialize the results before the competent judicial body, seeking to improve the quality guidelines of the role of the expert forensic psychologist within the Judicial System. The participation of expert psychologists from the Judicial Function of the Loja province was included, for which 20 surveys were carried out and 20 reports that these professionals carried out during 2020 were analyzed, of which the results and conclusions were obtained. After analyzing and interpreting the data, there is a lack of training for psychologist experts in the forensic area, a third of the analysis on the structure of the expert reports shows the absence of a scientific nature, since they do not have updated bibliographic citations; They do not use original reagents, nor informed consents, ambiguity in the object of the expertise, among the strengths it is highlighted that the majority use an adequate methodology, the results of the applied psychological reagents are described and they do not make biased judgments. Among the causes detected for non-compliance with good practices, the overload of judicial processes, inefficient deadlines and terms for the delivery of reports provided by the authorities, the lack of work materials and an adequate physical space that guarantees privacy.
Description: La presente investigación tuvo como objetivo conocer si los peritos psicólogos acreditados por el Consejo de la Judicatura de la Provincia de Loja aplican las buenas prácticas recomendadas y estandarizadas dentro del campo de la psicología forense, se analizará fortalezas y debilidades en la labor del psicólogo forense, consecuentemente se determinará las causas por las cuales las buenas prácticas no son aplicadas y la incidencia de este hecho en la calidad de las pericial realizadas para finalmente socializar los resultados ante el organismo judicial competente buscando mejorar las directrices de calidad del rol del perito psicólogo forense dentro del Sistema Judicial. Se cotó con la participación de los psicólogos peritos de la de la Función Judicial de la provincia de Loja, para lo cual se realizó 20 encuestas y se analizó 20 informes que estos profesionales realizaron durante el año 2020 de las cuales se obtuvo como resultado y conclusiones luego del análisis e interpretación de datos que existe una falta de formación de los peritos psicólogos en el área forense, un tercio del análisis en la estructura de los informes periciales arroja la ausencia de carácter científico, puesto que no cuentan con citas bibliográficas actualizadas; no usan reactivos originales, ni consentimientos informados, ambigüedad en el objeto de la pericia, entre las fortalezas se destacan que la mayoría utiliza una metodología adecuada, se describen los resultados de los reactivos psicológicos aplicados y no realizan juicios sesgados. Entre las causas detectadas para el incumplimiento de las buenas prácticas la sobrecarga de procesos judiciales, ineficientes plazos y términos para la entrega de informes dispuestos por las autoridades, la falta de materiales de trabajo y un espacio físico adecuado que garantice la privacidad.
