Abstract: El presente trabajo de investigación busca fortalecer el reconocimiento por parte de los operadores de justicia, especialmente de las y los jueces, respecto de los efectos de sentencia ejecutoriada y cosa juzgada del Acta de Mediación; y, su naturaleza jurídica de título de ejecución, previstos en el artículo 47 de la Ley de Arbitraje y Mediación y numeral 3 del artículo 363 del Código Orgánico General de Procesos; al momento de la solicitud de ejecución, por parte de quien se encuentra perjudicado por el incumplimiento de los compromisos suscritos por las partes y el mediador. Se analiza la potestad jurisdiccional del juez al momento de la admisibilidad, la motivación en virtud de la cual el juez exige al actor completar la demanda con documentos adicionales no previstos en la ley; y, la afectación al debido proceso, acceso a la justicia y a la seguridad jurídica, por el retraso o denegación del inicio del procedimiento de ejecución. Finalmente, se propone una reforma normativa que favorezca la celeridad procesal y la debida diligencia para admitir a trámite una solicitud de ejecución de un acta de mediación
Description: This research seeks to strengthen the recognition by the justice operators, especially the judges, regarding the effects of the final judgment and res judicata of the Mediation Act; and, its legal nature of execution title, provided for in article 47 of the Arbitration and Mediation Law and numeral 3 of article 363 of the General Organic Code of Processes; at the time of the execution request, by the party who is injured by the breach of the commitments signed by the parties and the mediator. The jurisdictional power of the judge at the time of admissibility is analyzed, the reasoning by virtue of which the judge requires the plaintiff to complete the claim with additional documents not provided for in the law; and, the affectation of due process, access to justice and legal security, due to the delay or denial of the start of the execution procedure. Finally, a normative reform is proposed that favors procedural speed and due diligence to admit a request for the execution of a mediation act.
