Abstract: | El presente trabajo de investigación se determina como se ha venido sustanciando la acción de impugnación de excepciones a la coactiva en el Código Orgánico General de Procesos, conjuntamente con la aplicación del Código Tributario, un repaso a la doctrina sobre la coactiva, análisis a las excepciones al procedimiento coactivo, para entender las excepciones a la coactiva tanto la de impugnación y las especiales. Un enfoque pormenorizado de los problemas procesales en la sustanciación de las excepciones a la coactiva, en cuanto a la aplicación de estas dos normas sobre la oportunidad para presentar la acción ante el Tribunal de lo Contencioso Tributario y evidenciar cada problema relacionado con la sustanciación de la acción de impugnación a la coactiva; el análisis a los métodos de interpretación de leyes a fin de dar una posible solución a un problema procedimental, investigar si invade el debido proceso cuando genera incertidumbre al no contemplar normas claras a ser aplicadas por la autoridad competente; por existir dos normas procesales vigentes, el problema jurídico existente ha sido evidenciado con casos prácticos, y con entrevistas a Abogados en libre ejercicio quienes tienen diversos criterios al momento de iniciar una acción de excepciones a la coactiva |
Description: | This research work is determined as has been substantiated the action to challenge exceptions to the coercive in the General Organic of Processes, together with the application of the Tax Code, a review of the doctrine on coercion, analysis of exceptions to the coercive procedure, to understand the exceptions to the coercive both the challenge and the special ones. A detailed approach to the procedural problems in the substantiation of the exceptions to the coercive, in terms of the application of these two rules on the opportunity to file the action before the Tax Litigation Court and evidence each problem related to the substantiation of the action to challenge the coercive; the analysis of the methods of interpretation of laws in order to give a possible solution to a procedural problem, investigate whether it invades due process when it generates uncertainty by not contemplating clear norms to be applied by the competent authority; Because there are two existing procedural norms, the existing legal problem has been evidenced by practical cases, and by interviews with free-ranging lawyers who have different criteria when initiating an action of exceptions to coercion |
