Abstract: En la legislación ecuatoriana la medida del apremio personal de privación de libertad se concibió como un medio de presión decretado por los jueces en caso de incumplimiento en el pago de dos o más cuotas de pensión alimenticia, la referida medida ejerce influencia en la voluntad de los obligados al cumplimiento de dicha acreencia por lo cual, al materializarse su pago, también se asegura la vigencia de tres principios básicos que protegen los derechos de niños, niñas y adolescentes, a saber: El del Interés Superior del niño, el de la supremacía y el de la corresponsabilidad tripartita, esto es, estado, sociedad y familia. Ante la legislación existente, nos preguntamos ¿El procedimiento establecido en el artículo 137 del COGEP, sustituido por la Corte Constitucional mediante sentencia número 012-17, garantiza el derecho de alimentos, a una vida digna y al desarrollo integral de niños, niñas y adolescentes e, igualmente, la seguridad jurídica? El objetivo central de este estudio fue analizar el apremio personal de privación de libertad en los juicios de alimentos, posterior a la derogatoria sustitutiva del Art. 137 del COGEP, ordenada por la Corte Constitucional en sentencia número:012-2017 y elaborar un texto de reforma definitiva al Art. 137 que incluyó alternativas válidas al apremio personal de privación de libertad, aplicables a nuestra realidad socio jurídica. El enfoque de la investigación fue cualitativo, empleando el método bibliográfico, documental. Los resultados de este trabajo concluyen que las medidas alternativas al apremio personal de privación de libertad son pertinentes pero, que dependen de varios factores unos, propios, de la Función Judicial, otros, ajenos a ella, lo cual obliga a repensar en una urgente colaboración interinstitucional, con las demás funciones del Estado y la adopción de nuevas medidas o, bién, la optimización de las ya existentes, para asegurar el cumplimiento de la obligación alimentaria como derecho fundamental para el desarrollo integral de nuestros niños, niñas y adolescentes.
Description: In Ecuadorian legislation, the measure of personal imprisonment deprived of liberty was conceived as a mean of pressure decreed by judges in the event of failure to pay two or more alimony payments. The measure exerts an influence on the will of the parties. They are obliged to comply to this claim so that when their payment gets materialised, the validity of three basic principles that protect the rights of children and adolescents are assured, namely: the higher interest of the child, the supremacy and the tripartite co-responsibility, that is state, society and family. Before the existing legislation, we ask ourselves: the procedure established in article 137 of the General Organic Code of Processes (COGEP), replaced by the Constitutional Court by means of sentence number 012-17, guarantees the right to food, a dignified life and the integral development of children and adolescents and, likewise, legal security. The primary objective of this study had been analysing the personal constraint of deprivation of liberty in food trials, after the substitute repeal of Art. 137 of the COGEP, ordered by the Constitutional Court in sentence number 012-017 to elaborate a text of final reform to Art. 137, which included valid alternatives to the personal constraint of deprivation of liberty, applicable to our socio-legal reality. The focus 12 of the research was qualitative, using the bibliographic, documentary method. The results of this work concluded that the alternative measures to the personal constraint of deprivation of liberty are pertinent. However, that depends on several factors of the Judicial Function, others, alien to it, which forces to urgently rethink inter-institutional collaboration, together with other functions of the State and the adoption of new measures and the optimization of existing ones, to ensure compliance with the food obligation as a fundamental right for the integral development of our children and adolescents.
