Abstract: | Los seres humanos a lo largo de la historia hemos comprobado que mientras más unidos estamos mejores resultados obtenemos. A lo largo de los tiempos se ha reconocido y garantizado el derecho a la asociación en instrumentos internacionales y nacionales debido a que se trata de un derecho humano de gran importancia en sociedades democráticas. La Ley Orgánica de Defensa del Consumidor del Ecuador establece en el artículo 62 numeral 2 que para conformar una asociación de consumidores se requiere de cincuenta personas, un número desproporcional si se toma en consideración el requerimiento en otros países para este tipo de organizaciones y en otras asociaciones en el Ecuador. Se ha evidenciado mediante el test de proporcionalidad que este requisito limita el ejercicio a la libertad de asociación contemplado en el artículo 66 numeral 13 de la Constitución del Ecuador por lo que es inconstitucional e ilegítimo y debe ser reformado ya que no permite la conformación de asociaciones de consumidores las cuales son una garantía extrainstitucional que coadyuvan al cumplimiento de los derechos de este colectivo al que pertenecemos todos y que diariamente sufre vulneraciones |
Description: | Human beings throughout history have proven that the more united we are, the better results we can achieve. Throughout time, the freedom of association has been recognized and guaranteed in international and national legal codes because it is a human right of great importance in democratic societies. The Organic Law of Consumer Protection of Ecuador establishes in Article 62 Section 2 that to form a consumer association, fifty people are required. This number is disproportionate and higher than other types of associations in other countries and for other associations in Ecuador. This requirement limits the exercise of the freedom of association stated in Article 66 Section 13 of the Ecuadorian Constitution, thus making the requirement of fifty people unconstitutional and illegitimate. Article 62 Section 2 of the Organic Law of Consumer Protection of Ecuador must therefore be reformed, since it does not allow the formation of consumer associations. These are an extra-institutional guarantee that contribute to the enforceability of the rights of consumers, a group to which we all belong and that suffers violations on a daily basis. |
