| Resumen : | La Constitución ecuatoriana presenta un paradigma en el que la protección de los derechos de la comunidad LGTBI no termina de concretarse. El matrimonio para parejas del mismo sexo se presenta como una figura jurídica que reivindica el derecho a la igualdad y no discriminación por orientación sexual como un principio rector de nuestro ordenamiento jurídico, el cual armoniza nuestra Constitución y permite el avance social. En este sentido esta investigación muestra la importancia de este derecho en el sistema jurídico nacional e internacional, y el mecanismo de interpretación para ser incorporado en la norma suprema, asimismo, presenta la evolución del concepto a la familia como un concepto social que debe adaptarse a la realidad y que no puede significar la restricción de derechos. |
| Descripción : | The Ecuadorian Constitution presents a paradigm in which the protection of the rights of the LGTBI community does not come to fruition. Marriage for same-sex couples is presented as a legal figure that claims the right to equality and non-discrimination based on sexual orientation as a guiding principle of our legal system, which harmonizes our Constitution and allows social progress. In this sense, this research shows the importance of this right in the national and international legal system, and the interpretation mechanism to be incorporated in the supreme norm, also presents the evolution of the concept of the family as a social concept that must be adapted to the reality and that can not mean the restriction of rights. |
