Resumen : Primeramente, para realizar este trabajo de investigación partiremos de la hipótesis que nos hemos planteado la cual nos pregunta si la justicia Constitucional ha tutelado de manera efectiva los derechos a la salud, trabajo e igualdad de las personas portadoras de VIH Sida en el ámbito público y privado. En este sentido analizaremos la sentencia 016-16-SEP-CC la misma que trata de la vulneración de derechos a la igualdad y a la salud en un agente policial quien además es portador de VIH- Sida. Es así como trataremos el tema del derecho a la igualdad y no discriminación el mismo que es un derecho social por excelencia. Se trata de un derecho complejo que se despliega en una amplia serie de posiciones jurídicas fundamentales para los particulares y para el Estado (Carbonell, 2016: 1,2). Este derecho se considera innato, inalienable y universal ya que es parte elemental para el ser humano por ser el titular del derecho natural y así mismo el Estado tiene la obligación de garantizarlo (Prieto, 2010: 96). Por otra parte, el derecho a la salud también genera la obligación del Estado de preservar el bien jurídico protegido por la Constitución, es decir, la igualdad; tal protección supone la obligación del Estado de abstenerse de discriminar, que es una obligación negativa; de la misma manera, hace nacer la obligación positiva de evitar que particulares, grupos o empresas lo vulneren (Carbonell, 2016: 1,2). El derecho a la igualdad obliga también a los particulares; así, por ejemplo, las empresas privadas están obligadas a contratar a una persona con independencia de su género, religión, etnia o preferencia sexual (Carbonell, 2016: 1,2). El Estado tiene obligación de garantizar que se cumpla la igualdad y no discriminación como podemos evidenciar en el Artículo 11 numeral 2 de la Constitución del Ecuador que reza lo siguiente: “Todas las personas son iguales y gozarán de los mismos derechos, deberes y oportunidades”.
Descripción : Firstly, in order to carry out this research work, we will start from the hypothesis that has been raised, which asks us if the Constitutional Justice has effectively protected the rights to health, work and equality of people carrying HIV AIDS in the public sphere and private. In this sense, we will analyze sentence 016-16-SEP-CC, the same one that deals with the violation of rights to equality and health in a police agent who is also a carrier of HIV-AIDS. This is how we will treat the issue of the right to equality and non-discrimination, which is a social right par excellence. It is a complex right that unfolds in a wide range of fundamental legal positions for individuals and for the State (Carbonell, 2016: 1,2). This right is considered innate, inalienable and universal since it is an elementary part for the human being to be the holder of the natural right and likewise the State has the obligation to guarantee it (Prieto, 2010: 96). On the other hand, the right to health also generates the obligation of the State to preserve the legal right protected by the Constitution, that is, equality; such protection implies the obligation of the State to refrain from discriminating, which is a negative obligation; in the same way, it gives rise to a positive obligation to prevent individuals, groups or companies from violating it (Carbonell, 2016: 1,2). The right to equality also binds individuals; thus, for example, private companies are obliged to hire a person regardless of their gender, religion, ethnicity or sexual preference (Carbonell, 2016: 1,2). The State has an obligation to ensure that equality and non-discrimination are met, as we can see in Article 11, paragraph 2 of the Constitution of Ecuador, which reads as follows: "All persons are equal and shall enjoy the same rights, duties and opportunitie
