Abstract: Con la expedición de la Ley de Minería en el Suplemento de Registro Oficial No. 517 de 29 de Enero del 2009, que derogó la Ley de Minería No.126, se han generado grandes expectativas y controversias sociales sobre la posibilidad que este nuevo marco legal minero, permita una adecuada explotación del gran potencial de recursos auríferos con los que cuenta el país. La nueva Ley de Minería ha transformado en forma radical las figuras jurídicas relacionadas con el otorgamiento y conservación de derechos mineros, tanto es así que a la fase de exploración minera la ha subdividido en dos fases, esto es, exploración inicial que puede durar hasta 4 años, y la exploración avanzada 4 años adicionales. Igualmente el otorgamiento de concesiones, por medio de títulos mineros únicamente para la fase de exploración; y, para ejecutar trabajos de producción, beneficio, fundición y refinación, en forma obligatoria se dispone que se debe que suscribir un contrato de explotación o de prestación de servicios. También es indispensable destacar que la Ley de Minería vigente pone mucho énfasis en el control ambiental y en la participación social de la población inmersa en zonas mineras. Todos estos cambios se los ha considerado necesarios para el estudio y análisis plasmados en el presente trabajo investigativo que sin lugar a dudas permitirá que los sectores involucrados en el sector minero, se familiaricen con la nueva normativa minera.
With the issuance of the Mining Law in the Official Registry Supplement No. 517 of January 29, 2009, which repealed the Mining Law No.126, great expectations and social controversies have been generated about the possibility that this new legal framework mining, allow an adequate exploitation of the great potential of gold resources that the country has. The new Mining Law has radically transformed the legal concepts related to the granting and conservation of mining rights, so much so that the mining exploration phase has been subdivided into two phases, that is, initial exploration that can last up to 4 years. years, and advanced exploration 4 additional years. Also the granting of concessions, by means of mining titles only for the exploration phase; and, in order to carry out production, benefit, smelting and refining works, it is compulsory that a contract for the exploitation or rendering of services must be signed. It is also essential to emphasize that the current Mining Law places great emphasis on environmental control and social participation of the population immersed in mining areas. All these changes have been considered necessary for the study and analysis embodied in this research work that will undoubtedly allow the sectors involved in the mining sector to become familiar with the new mining regulations.
