Abstract: La prueba, “la demostración de un hecho del cual se deriva el derecho que se pretende, no constituye propiamente una obligación sino una necesidad práctica, una carga, un peso”1; carga que se traduce en la situación en la que se halla una persona (el litigante o interesado) que sostiene un hecho o reclama un derecho, debiendo probar la existencia del uno o del otro, es decir, la existencia del fundamento de su pretensión. Teniendo claro que la carga de la prueba es la oportunidad probatoria otorgada a las partes para satisfacer la convicción del juez respecto de sus afirmaciones, debemos enfocarnos en la importancia que dicha situación tiene en nuestra legislación; iniciando por señalar que la base jurídica sobre la que la legislación ecuatoriana fundamenta tanto la definición como el alcance de la carga de la prueba u onus probandi, se halla prevista en la Sección 7º del Título I, Libro II del Código de Procedimiento Civil. La normativa establecida por el artículo 113 del Código de Procedimiento Civil en la que se señala que “es obligación del actor probar los hechos que ha propuesto afirmativamente en el juicio, y que ha negado el reo”; así como aquella del artículo 114 ibídem que determina que “cada parte está obligada a probar los hechos que alega, excepto los que se presumen conforme a la ley”; son reglas del legislador que más bien se han transformado en principios a los que podríamos calificar de generales, ya que la gran mayoría de legislaciones comparten y defienden el mismo parecer. Tomando en cuenta lo trascendental que resulta ser la distribución del onus probandi no sólo durante la etapa probatoria, sino a lo largo del proceso, y en especial al momento de dictarse una sentencia, es posible sostener que la normativa con la que cuentan nuestros jueces no logra satisfacer las necesidades legales que continuamente surgen en esta fase.
The proof, "the demonstration of an event from which the right is derived, is not properly an obligation but a practical necessity, a burden, a weight" 1; burden that translates into the situation in which a person (the litigant or interested party) is that sustains a fact or claims a right, having to prove the existence of one or the other, that is, the existence of the basis of his claim. Bearing in mind that the burden of proof is the evidentiary opportunity granted to the parties to satisfy the conviction of the judge regarding his statements, we must focus on the importance that this situation has in our legislation; starting by pointing out that the legal basis on which the Ecuadorian legislation bases both the definition and the scope of the burden of proof or onus probandi, is foreseen in Section 7 of Title I, Book II of the Code of Civil Procedure. The regulations established by article 113 of the Code of Civil Procedure in which it is stated that "it is the obligation of the plaintiff to prove the facts that he has proposed affirmatively in the trial, and that the defendant has denied"; as well as that of article 114 ibidem that determines that "each party is obliged to prove the facts that it alleges, except those that are presumed according to the law"; they are rules of the legislator that have rather become principles to which we could qualify as generals, since the great majority of legislations share and defend the same opinion. Taking into account the transcendental nature of the distribution of the onus probandi not only during the evidentiary phase, but throughout the process, and especially at the moment of issuing a judgment, it is possible to maintain that the regulations with which our judges have no manages to satisfy the legal needs that continually arise in this phase.
