| Zusammenfassung: | En el delito de violación es importante analizar cuál es la prueba o cuáles son las pruebas relevantes y decisivas dentro del juicio, puesto que las circunstancias en las que esta infracción se comete, comúnmente, sin testigos y en lugares cerrados, esta investigación determinará que no todos los medios de prueba son determinantes en todos los procesos, si no de la circunstancia de cada caso. El presente trabajo investigativo se basa en la teoría de la prueba para determinar si por parte de la doctrina se establecen parámetros para la presentación de pruebas en este delito. Dentro de esta investigación se analizó una sentencia, en la cual se sustenta la posición teórica asumida por los jueces al momento de resolver. |
| Beschreibung: | In the crime of violation, it is important to analyze which the evidence is or what the relevant and decisive evidence is in the trial; since the circumstances in infraction is committed, commonly happen without witnesses and in closed places, this investigation will determine that not all media evidence are determinant in all processes, if not in the circumstance of each case. The present investigative document is based on the theory of the test to determine if the doctrine establishes parameters for the presentation of evidence in this crime.
