Abstract: El presente trabajo analiza el ejercicio de la potestad coactiva, facultad con fin recaudatorio originalmente propia al Estado, otorgada hoy en día a los liquidadores de las entidades financieras en proceso de liquidación, por disposición del Código Orgánico Monetario y Financiero. El enfoque se hace en las entidades financieras de la economía popular y solidaria, cooperativas de ahorro y crédito, en consideración a los factores que las atañen, tales como: causal de liquidación forzosa, segmento al que pertenecen, fondos disponibles, costo del ejercicio de la potestad coactiva versus recuperación de cartera vencida Además estudia la normativa bajo la cual los liquidadores están ejerciendo esta potestad y las dificultades que se presentan; y, se realiza un análisis breve de la normativa bajo la cual deberán ceñirse a partir del 7 de julio de 2018, con la entrada en vigencia del Código Orgánico Administrativo.
Description: The present work analyzes the exercise of coactive power, a faculty with a collection purpose originally proper to the State; granted, nowadays, to the liquidators of the financial entities in liquidation process, by disposition of the Monetary and Financial Organic Code. The approach is made in the financial entities of popular and solidary economy, savings and credit cooperatives, in consideration to factors that concern them, such as: cause of a forced liquidation, the segment to which they belong, available funds, exercise cost of the coactive power versus recovery of the past due loans. In addition, it studies the regulations under which the liquidators are exercising this power and the difficulties that arise; and, a brief analysis is made about the regulations under which they will have to adhere starting on July 7, 2018, with the entry into force of the Organic Administrative Code.
