Abstract: La actividad administrativa del Estado debe garantizar el respeto del debido proceso, para lo cual debe estar compuesta por procedimientos adecuados al momento de pronunciarse sobre sus actuaciones. Sin embargo, la falta de motivación en sus actos administrativos, ocasiona incidentes importantes en sus resoluciones, produciendo acciones y efectos jurídicos adversos a los legales. El objetivo de esta investigación es analizar las variables de fondo y forma de las sentencias emitidas en los años 2016 y 2017, por el Tribunal Distrital de lo Contencioso Administrativo del Distrito Metropolitano de Quito, de procedimientos ordinarios, cuya Litis se enmarca en la motivación de los actos administrativos formulados por la Contraloría General del Estado, al momento de emitir las Resoluciones de Responsabilidad Civil. Del análisis realizado, se determinan elementos similares en las Resoluciones emitidas por la Contraloría General del Estado como falta de motivación, términos precluídos, e inobservancia de caducidad. Estos elementos han generado vicios de incompetencia para pronunciarse sobre los hechos auditados y han vulnerado la seguridad jurídica por parte de la Autoridad.
Description: The Government´s administrative activity must guarantee the respect to due process for that it must be composed of adequate procedures to support the State decisions. However, the lack of motivation in its administrative acts causes some important incidents that produce adverse legal effects in its final resolutions. This thesis analyses the background of sentences issued by the Administrative Court of the Metropolitan District of Quito, in 2016 and 2017, in which ordinary procedures the Litis is framed on the motivation of the administrative acts formulated by the General Comptroller of the State in Civil Liability Resolutions. Similar elements are determined in the Resolutions issued by the General Comptroller of the State as lack of motivation, precluded terms, and inobservance of expirations dates. These elements have generated an incompetence pronounce on the facts audited and violate the law.
