Abstract: El objeto del presente estudio ha sido el determinar si la reforma al Código del Trabajo promulgada en el Registro Oficial número 146 del 13 de agosto de 2003, a través de la cual se introduce el Procedimiento Oral como medio para la solución de las controversias laborales; ha sido un paso idóneo por parte del legislador ecuatoriano. Para dicho efecto se ha tomado como punto de partida al procedimiento entendiendo al mismo como el orden y método destinado a investigar si se dan los requisitos de existencia de la pretensión de tutela jurídica, una vez entendido el procedimiento, se ha desenmarañado las ventas y desventajas del procedimiento escrito y de igual forma se ha procedido con el procedimiento oral desde la perspectiva de la Teoría General del Proceso. Una vez analizadas las características de cada sistema dentro del ámbito teórico, se realizó un estudio pormenorizado del procedimiento Verbal Sumerio sistema utilizado anteriormente en el Ecuador y del actual Procedimiento Oral, concluyendo que la introducción de un proceso oral, desarrollado mediante audiencias donde priman los principios de inmediación, concentración, celeridad, son un avance definitivo dentro de la correcta administración de justicia del Ecuador. Respecto de la aplicación del sistema oral es recomendable que se corrija aspectos prácticos, como la lucha contra saturación de los juzgados de trabajo y que se busque unificar criterios en la aplicación de la norma a lo largo de los diferentes distritos donde operan dichos juzgados.
The object of the present study has been to determine if the reform to the Labor Code promulgated in the Official Registry number 146 of August 13, 2003, through which the Oral Procedure is introduced as a means for the solution of labor disputes; It has been an ideal step on the part of the Ecuadorian legislator. For this purpose, the procedure has been taken as the starting point, understanding it as the order and method used to investigate whether the requirements for the existence of the legal guardianship exist, once the procedure is understood, sales and disadvantages have been unraveled of the written procedure and in the same way proceeded with the oral procedure from the perspective of the General Theory of the Process. Once analyzed the characteristics of each system within the theoretical scope, a detailed study of the Sumerian Verbal procedure previously used in Ecuador and the current Oral Procedure was carried out, concluding that the introduction of an oral process, developed through hearings where the principles prevail of immediacy, concentration, speed, are a definite advance in the correct administration of justice in Ecuador. Regarding the application of the oral system, it is advisable to correct practical aspects, such as the fight against saturation of labor courts and to seek to unify criteria in the application of the rule throughout the different districts where these courts operate.
