Title: La justicia restaurativa en el sistema penal ecuatoriano

Abstract: El sistema penal en el Ecuador y la justicia tradicional lamentablemente no goza de la confianza ciudadana, más bien existe un escepticismo hacia su obrar y resultados. No solamente ha disminuido su capacidad para constituirse en el referente de un orden de derecho sino que con su eficiencia cada vez más limitada tiende a agravar la situación del país. La justicia tradicional o justicia retributiva mira el crimen como una infracción a la norma, una ofensa al Estado y ha desplazado a la víctima, olvidando que es una parte fundamental en el proceso, otorgándole protagonismo al Estado y al infractor. Mientras que la justicia restaurativa tiene un enfoque reintegrativo y busca la reparación integral de ofendido, procesado y comunidad; reconoce que la ofensa es contra la víctima y busca reparar el daño causado, le brinda la oportunidad al infractor de rectificar y de reparar el daño causado, quitándose la etiqueta de delincuente, ya que se ha comprobado que la privación de libertad a fracasado en lo que tiene que ver con la rehabilitación del reo, y finalmente la comunidad se involucra en el proceso de prevención y procesos de monitoreo para reducir la delincuencia. Surgen algunas corrientes que dicen que la justicia restaurativa desvirtúa o contradice los fines del derecho penal y de la pena. Frente a esto, luego de un cauteloso análisis he determinado que la justicia restaurativa no busca crear una nueva función o fin al derecho penal ni a la pena, sino que se puede encasillar perfectamente dentro de las funciones de prevención, ya que la reparación también busca la prevención. La aplicación de la justicia restaurativa en nuestro país permitirá utilizar de modo más eficiente el sistema de justicia penal, la cual enfocará sus esfuerzos y recursos limitados en los delitos más graves, además ayudará a reducir la población de las cárceles, ya que se presenta como una alternativa diferente a la privación de libertad
The penal system in Ecuador and traditional justice regrettably does not enjoy the public confidence, rather there is a skepticism towards its actions and results. Not only has its ability to become the benchmark of an order of law diminished, but with its increasingly limited efficiency tends to aggravate the situation of the country. Traditional justice or retributive justice views crime as an infraction of the norm, an offense against the State and has displaced the victim, forgetting that it is a fundamental part of the process, giving prominence to the State and the offender. While restorative justice has a reintegrative approach and seeks the integral reparation of offended, processed and community; recognizes that the offense is against the victim and seeks to repair the damage caused, gives the opportunity to the offender to rectify and repair the damage caused, removing the label of offender, since it has been proven that the deprivation of liberty has failed that has to do with the rehabilitation of the inmate, and finally the community is involved in the prevention process and monitoring processes to reduce crime. Some currents appear that say that restorative justice distorts or contradicts the aims of criminal law and punishment. Faced with this, after a cautious analysis I have determined that restorative justice does not seek to create a new function or end to criminal law or punishment, but can be perfectly framed within the functions of prevention, since the repair also seeks prevention. The application of restorative justice in our country will make it possible to use the criminal justice system more efficiently, which will focus its efforts and limited resources on the most serious crimes, as well as help reduce the population of prisons, since it is presented as an alternative to deprivation of liberty
