Abstract: Aquella ley primitiva en la que el más fuerte prevalecía sobre el débil, donde la fortaleza radicaba en la imposición de la supremacía física, ya es obsoleto, inmoral y digno de sanción; en la actualidad este factor de poderío se ha transformado en el conocimiento y utilización de las nuevas tecnologías, ya que para sobresalir y ser competitivos es necesario estar a la vanguardia de la informática. El Internet es considerado como el mayor deposito de información y vía efectiva de comunicación, donde su crecimiento es constante e inmenso. Gracias a él, las transacciones se han facilitado ya que sus usuarios son capaces de establecer vínculos de forma instantánea, reduciendo costos y acortando distancias, constituyéndose en la mejor herramienta para el desarrollo económico mundial. Conforme vamos creciendo y nuestra interacción social va en aumento, hemos evidenciado como la informática simplifica tanto nuestras actividades productivas como sociales, llevándonos a la conclusión de que su estudio, entendimiento y desarrollo profundo son de vital importancia, por que estar al tanto de la mera búsqueda de información o de la comunicación electrónica básica, no son suficientes para alcanzar los verdaderos beneficios que el Internet nos brinda. Como sabemos, el Derecho no es una ciencia estática, por el contrario, es de evolución asidua donde su dinamismo depende y avanza conforme el desarrollo social se acrecienta. El surgimiento de una nueva actividad, un artefacto o una naciente realidad humana conlleva la necesidad de tipificarlos legalmente, a fin de mantener el cometido de regulación y control humano que tiene el Derecho. Es por esta razón, que el ámbito tecnológico es de suma importancia jurídica, ya que este involucra y afecta a la gran mayoría de ramas, como a las actividades humanas. Es innegable el avance informático desmesurado, donde la vigencia y efectividad de un logro técnico en poco tiempo es transmutado a un método obsoleto por el nacimiento de uno nuevo; en virtud de ello, es preciso para la sociedad contar con un marco jurídico de vigencia constante, para que el adelanto informático no afecte de manera inmediata al régimen jurídico. Es así que, la firma electrónica como medio de identificación de 2 autoría y portadora de reconocimiento y responsabilidad legal, en la actualidad instituye la vía más eficiente y moderna, pero con el pasar del tiempo aparecerá una nueva metodología que la vuelva inútil, dando como resultado su desuso, sin embargo, la esencia del proceso siempre será la misma, es decir, la determinación de identidad del emisor y receptor para darle un valor legal de sus transacciones a través de la Red sin importar cual sea la técnica que utilicen, logrando vigencia de la misma normativa legal. Me he planteado como principal objetivo el inquirir en las legislaciones, técnicas y campos de aplicación, tanto internacionales como nacionales, que envuelve la aplicación de la firma electrónica, con el fin ulterior de determinar sus beneficios y falencias de toda índole. El presente texto está conformado de cinco capítulos, en los cuales se ha procurado tratar la temática de mayor relevancia, cuyo contexto no versa de meras citas o transcripciones documentales, por el contrario, se lo ha destinado al razonamiento, síntesis y elaboración de nuevas teorías que beneficien a su aplicación; para esto, su desarrollo se encuentra enfocado de forma didáctica a fin de evadir la exclusión de lectores que carezcan de conocimientos básicos sobre el tema.
That primitive law in which the strongest prevailed over the weak, where the strength lay in the imposition of physical supremacy, it is already obsolete, immoral and worthy of sanction; at present this factor of power has been transformed into the knowledge and use of new technologies, because to excel and be competitive is necessary to be at the forefront of computing. The Internet is considered as the largest repository of information and effective way of communication, where its growth is constant and immense. Thanks to them transactions have been facilitated since their users are able to establish links instantaneously, reducing costs and shortening distances, becoming the best tool for global economic development. As we grow and our social interaction increases, we have evidenced as computerization simplifies both our productive activities and social, leading us to the conclusion that their study, understanding and development are of vital importance, because to be aware of the mere search for information or basic electronic communication, are not sufficient to reach the true benefits that the Internet offers us. As we know, Law is not a static science, on the contrary, it is evolution assiduous where its dynamism depends and advances as the social development increase The emergence of a new activity, an artifact or a nascent reality human rights implies the need to legally typify them, in order to maintain the of regulation and human control that the Law has. It is for this reason, that the scope technology is of utmost legal importance, since it involves and affects the great most branches, as to human activities. Uncompromising computer advancement is undeniable, where the validity and effectiveness of a technical achievement in a short time is transmuted to an obsolete method by the birth of new one; In virtue of this, it is necessary for society to have a legal framework of constant validity, so that the computer advance does not immediately affect the legal regime. Thus, the electronic signature as a means of identifying two authorship and carrier of recognition and legal responsibility, currently institutes the most efficient and modern way, but with the passing of time a new methodology that renders it useless, resulting in its disuse, however, the The essence of the process will always be the same, that is, the determination of the identity of the sender and receiver to give a legal value of their transactions through the Network without import whatever technique they use, achieving validity of the same legal regulations. I have considered as the main objective the inquiry in the legislations, techniques and fields of application, both international and national, involving the application of the electronic signature, for the further purpose of determining its benefits and flaws of all kinds. This text is made up of five chapters, in which we have tried deal with the most relevant topic, whose context does not refer to mere appointments or documentary transcripts, on the contrary, it has been destined to the reasoning, synthesis and elaboration of new theories that benefit its application; for this, your development is focused in a didactic way in order to avoid the exclusion of readers who lack basic knowledge on the subject.
