Abstract: | Se entiende como documento el medio de conservación de los actos y hechos ya contraídos por los individuos en general, que son producto de un acto humano y que representan pensamientos, hechos, objetos o escenas naturales de la humanidad, así como el hecho de que deben expresarse por escrito, sin importar el material sobre el cual se escriba. Por su parte los instrumentos son una diversa especie de documentos que generalmente consisten en escritos, pudiendo encontrarse éstos dentro de la categoría de privados o públicos. El instrumento público es aquél otorgado y/o autorizado con las solemnidades requeridas por la ley, ya sea por Notario o en general funcionario público, que se encuentre dentro del límite y competencia de sus atribuciones e investidos de fe pública, en cambio los documentos privados tanto sólo deben constar por escrito, pudiendo intervenir en su formación cualquier persona natural o jurídica, que sea capaz y cumpla con los requisitos para contraer derechos y obligaciones. La posibilidad de que existan instrumentos públicos electrónicos, es una innovación moderna en nuestra legislación. Tanto los documentos públicos como privados pueden en lo que respecta a su admisión como medios de prueba, constituir medios probatorios o indicios, en distintas situaciones jurídicas o contiendas legales; según lo determina la ley sustantiva y adjetiva de nuestro país.
