Abstract: El primer capítulo analiza las principales autoridades que tienen la competencia para aplicar las sanciones correspondientes ante el incumplimiento de las normas ambientales existentes; enfocado directamente en la Ordenanza Metropolitana 213, del Distrito Metropolitano de Quito: Sustitutiva del Título V, “Del Medio Ambiente”, Libro Segundo, del Código Municipal, objeto del estudio, ya que siendo ésta de suma relevancia nos da la pauta idónea para enseñarnos las responsabilidades y obligaciones para conservar nuestro medio ambiente. Es así que, a principios de los años noventa se inicia un proyecto para evaluar en las zonas urbanas la contaminación del medio ambiente en la ciudad de Quito, dichas acciones fueron precisas para encaminar programas y proyectos para el saneamiento ambiental detectado en ese entonces. La dinámica del equipo técnico de este proyecto generó justificadamente la necesidad de que exista una unidad estructurada como parte de la institucionalidad de la Municipalidad, considerando sobre todo elementos de aplicación de la normativa ambiental vigente. En este sentido entonces, en el año 1991 se creó el Departamento de Control de Calidad Ambiental como parte de la estructura orgánica funcional de la Dirección Municipal de Higiene. Durante la gestión municipal de 1994, se crea la Dirección de Medio Ambiente siendo esta Dirección una nueva estructura administrativa adoptada por el Distrito Metropolitano de Quito. Esta modernización del gobierno local, determinó el inicio de un proceso de fortalecimiento institucional de dicha dirección, tomando en cuenta que la nueva Ley de Régimen para el Distrito Metropolitano de Quito le asignaba competencias exclusivas y privativas en materia ambiental. Sin embargo por circunstancias institucionales la unidad ambiental creada se fue debilitando, ya que el poder de decisión se centra en el Concejo Metropolitano de Quito. En la actualidad, se ha desconcentrado la Gestión Ambiental administrativamente, desde la Dirección Metropolitana de Medio Ambiente hacia las ocho Administraciones Zonales existentes, con el fin de que se determinen las debilidades institucionales y se concentren esfuerzos para fortalecer los procesos de mejoramiento de la calidad de vida en el Distrito Metropolitano de Quito.
The first chapter analyzes the main authorities that have the competence to apply the corresponding sanctions in case of non-compliance with existing environmental regulations; focused directly on Metropolitan Ordinance 213, Metropolitan District of Quito: Substitute Title V, "Environment", Second Book, Municipal Code, object of the study, since being of great importance gives us the ideal guide to teach us the responsibilities and obligations to conserve our environment. Thus, at the beginning of the nineties, a project was started to evaluate the pollution of the environment in the city of Quito in urban areas. These actions were necessary to direct programs and projects for the environmental sanitation detected at that time. The dynamics of the technical team of this project justifiably generated the need for a structured unit as part of the institutionality of the Municipality, considering above all elements of application of current environmental regulations. In this sense, then, in the year 1991, the Department of Environmental Quality Control was created as part of the functional organic structure of the Municipal Hygiene Department. During the municipal management of 1994, the Environmental Directorate was created, this Directorate being a new administrative structure adopted by the Metropolitan District of Quito. This modernization of local government, determined the beginning of a process of institutional strengthening of this direction, taking into account that the new Regime Law for the Metropolitan District of Quito assigned exclusive and exclusive competences in environmental matters. However, due to institutional circumstances, the environmental unit created was weakened, since the power of decision is centered in the Metropolitan Council of Quito. At present, Environmental Management has been decentralized administratively, from the Metropolitan Directorate of the Environment to the eight existing Zonal Administrations, in order to determine institutional weaknesses and focus efforts to strengthen the processes of improvement of the quality of life in the Metropolitan District of Quito.
