Abstract: | La presente tesis de grado, tiene como objetivo fundamental , llegar a
presentar y poner a consideración de las autoridades respectivas, un Proyecto de Ley
de la Eutanasia.
Para poder cumplir con el objetivo propuesto, me he planteado la necesidad
de realizar un exhaustivo estudio y análisis de lo que es y constituye la Eutanasia
dentro de los diferentes campos en los que se desarrolla el hombre, los mismos que
nos permitirán centrar y ubicar a la problemática de primer orden que formula la
eutanasia y que es, la posibilidad de hacer surgir en el titular del derecho a la vida,
la facultad de libre disposición sobre su existencia; es decir, plantear la compleja
interrogante de determinar, si el derecho a la vida incluye el derecho a la propia
muerte.
El presente trabajo lo he realizado en ocho capítulos , los mismos que van
desarrollándose de acuerdo a diferentes consideraciones, de estudio y análisis de lo
que constituye la eutanasia; procediendo inicialmente a referirme: a la evolución
histórica y las corrientes filosóficas relacionadas con la eutanasia, a emitir varios
conceptos fundamentales sobre la misma y establecer su división y clases.
Con el tratado de la vida y de la muerte inicio mi estudio, partiendo del
hecho, que en todas las sociedades modernas organizadas se protege y garantiza con
especial énfasis el derecho a la vida, y que , en todas las cartas constitucionales de
todos los países del mundo, se le reconoce y se le ubica a este derecho, dentro de la
categoría de un bien supremo que debe ser celosamente cuidado; la vida, por lo tanto
se la define dentro de la ley, como un derecho inviolable, cuya vulneración suele
acarrear consecuencias de orden jurídico-penal, de manera que las conductas que
lesionan este bien tan preciado, son sancionadas con penas de diferente índole.
La discusión sobre el derecho a la vida, se centra en relación a la definición
intrínseca de la misma, lo que permite llegar a definir si este derecho fundamental tiene carácter absoluto, o si por el contrario, puede ser razonablemente limitado en
determinadas circunstancias .
La práctica de la eutanasia dentro de la sociedad , plantea una gran
controversia especialmente en lo que se refiere al derecho de la vida, por lo que,
esta elección ha sido condenada y defendida durante miles de años por diferentes
miembros de la sociedad y particularmente por las doctrinas de la moral, que se dan
en la diferentes religiones; y que por un lado, defienden la vida humana, la cual tiene
para ellas un carácter de sagrado e intrínseco, mientras que por otro, existe el
planteamiento de ideologías según las cuales, el derecho a la vida es relativo en
determinadas circunstancias de conflicto. Del resultado de esta posiciones
contrapuestas , se va estableciendo el porqué de la conflictividad que produce la
eutanasia dentro de la sociedad y cuales sus repercusiones que inciden en la vida real De esta situación , se destaca a la eutanasia frente a: la posición del estado
dentro del aspecto jurídico-político, los derechos humanos , la moral y la iglesia, los
principios de las diferentes religiones; además: la aplicación de la Eutanasia en la
Medicina, la aplicación de la Eutanasia en enfermedades graves e incurables,
opiniones a favor y en contra de la misma. The present thesis, has as its fundamental objective, to reach present and put to the consideration of the respective authorities, a Bill of Euthanasia. In order to fulfill the proposed objective, I have considered the need to carry out an exhaustive study and analysis of what is and constitutes Euthanasia within the different fields in which man develops, the same as will allow us to focus and locate the problem of the first order that formulates the euthanasia and that is, the possibility of giving rise to the holder of the right to life, the faculty of free disposition over its existence; that is, to pose the complex question to determine, if the right to life includes the right to one's own death. I have done this work in eight chapters, the same ones that go developed according to different considerations, study and analysis of what which constitutes euthanasia; proceeding initially to refer to: evolution historical and philosophical currents related to euthanasia, to issue several fundamental concepts about it and establish its division and classes. With the treaty of life and death I begin my study, starting from fact, that in all organized modern societies it is protected and guaranteed with special emphasis on the right to life, and that, in all the constitutional letters of all the countries of the world, it is recognized and placed to this right, within the category of a supreme good that must be jealously guarded; life, therefore it is defined within the law, as an inviolable right, whose violation tends bring legal-criminal consequences, so that the behaviors that they injure this precious asset, they are sanctioned with different types of punishment. The discussion on the right to life, focuses on the definition intrinsic to it, which allows us to define whether this fundamental right is absolute, or if, on the contrary, it can be reasonably limited in certain circumstances. The practice of euthanasia within society poses a great controversy especially as regards the right to life, so, This election has been condemned and defended for thousands of years by different members of society and particularly by the doctrines of morality, which are given in different religions; and that on the one hand, they defend human life, which has for them a character of sacred and intrinsic, while on the other, there is the approach of ideologies according to which, the right to life is relative in certain circumstances of conflict. From the result of this positions opposed, the reason for the conflict that produces the euthanasia within society and what its repercussions affecting real-life situation, stands against euthanasia: the state's position within the legal-political aspect, human rights, morals and the church, principles of different religions; in addition: the application of Euthanasia in the Medicine, the application of Euthanasia in serious and incurable diseases, opinions for and against it. |
