Abstract: | Debido a la globalización del mundo actual y a las crecientes relaciones del
comercio, el mundo mercantil se ha visto en la necesidad de crear un mecanismo
expedito para la resolución de los diferendos restantes de las relaciones
comerciales.
La desconfianza, el congestionamiento y la falta de especialidad de los tribunales
de justicia ordinarios han creado la necesidad de un sistema investido de
competencia para intervenir en las controversias surgidas con motivo de los
negocios internacionales.
La velocidad de las relaciones de comercio se han incrementado por la rapidez de
los medios de transporte y comunicación, haciendo del tiempo un verdadero
factor preponderante, que no puede ser desperdiciado en la demorada resolución
de un conflicto.
Las relaciones comerciales se fundamentan en la libertad de contratación, que
haciendo uso legítimo de ese derecho, les han permitido a los comerciantes el
optar por una jurisdicción distinta a la convencional.
Frente a la proliferación de los métodos alternativos de solución de conflictos y la
vigencia aún de los procesos judiciales, se hace necesaria la existencia de un
método alternativo, que cumpla con las características de contrariedad, oposición
y obligatoriedad del proceso judicial, y la eficacia, prontitud y conveniencia de los
métodos alternativos, ese es el arbitraje comercial internacional.
El arbitraje comercial internacional, se ha convertido hoy en día, en el mecanismo
procesal más idóneo para resolver las controversias surgidas de los negocios
internacionales, por brindar garantías procesales, rapidez, eficacia, confianza,
seguridad y resoluciones justas. Due to the globalization of the current world and the growing relations of the trade, the merchant world has seen the need to create a mechanism expedient for the resolution of the remaining differences of the relations commercial. Mistrust, congestion and lack of specialty of the courts ordinary courts have created the need for a system vested with competence to intervene in disputes arising from the international Business. The speed of trade relations have increased due to the speed of the means of transport and communication, making time a true preponderant factor, which can not be wasted in the delayed resolution of a conflict. The commercial relations are based on freedom of contract, which legitimate use of that right, they have allowed merchants the opt for a jurisdiction other than the conventional one. Faced with the proliferation of alternative methods of conflict resolution and still valid of the judicial processes, it is necessary the existence of a alternative method, which meets the characteristics of contrariety, opposition and the compulsory nature of the judicial process, and the effectiveness, promptness and convenience of the alternative methods, that is international commercial arbitration. International commercial arbitration has become today, in the mechanism most appropriate procedure to resolve disputes arising from business international, for providing procedural guarantees, speed, efficiency, trust, security and fair resolutions. |
