Abstract: | Es evidente que el Derecho vive un momento histórico, puesto que debe
responder a los nuevos y complejos problemas que plantea la celeridad y
profundidad de avance tecnológico en general y de la informática en particular.
El advenimiento de la sociedad tecnológica cuyo actor principal es el
computador determinó que actualmente nos encontremos enfrentados a un
proceso de crisis y de transformación de nuestra civilización jurídica.
La informática trazó un nuevo rumbo para el derecho, le abrió nuevas
perspectivas. Este nuevo derecho que nace debe regular las diversas relaciones
jurídicas y no solo en un campo sino dentro de todos los campos, y que
evidentemente se producen a raíz del uso y abuso de la informática, que
conjuntamente con las telecomunicaciones hacen que las relaciones se vuelvan
más complejas y nace la necesidad de regularlas.
Hablar de Derecho Informático, es hablar de el derecho que debe regular
las nuevas tecnologías, por el propósito de denominar así este trabajo de
investigación va mucho más allá, por que no solo consiste en la posibilidad de
regular las nuevas tecnologías sino de crear un nuevo entorno jurídico que cada
día se hace mas grande y más importante.
Con el presente trabajo de investigación se pretende demostrar la utilidad
de la cátedra de derecho Informático y la importancia de que se constituya como
una rama autónoma a que varios tratadistas pretenden vincularla con otras ramas
tradicionales del derecho en general con el fin de que el derecho informático
dependa en su estructura y regulación de otras ramas del derecho It is evident that the Law lives a historical moment, since it must respond to the new and complex problems posed by celerity and depth of technological progress in general and of information technology in particular. The advent of the technological society whose main actor is the computer determined that we are currently faced with a process of crisis and transformation of our legal civilization. The computerized a new direction for the law, it opened new perspectives. This new right that is born must regulate the various relationships legal and not only in one field but within all fields, and that evidently they are produced as a result of the use and abuse of information technology, which together with telecommunications they make relationships become more complex and there is a need to regulate them. Speaking of Computer Law, is talking about the right that should regulate new technologies, for the purpose of naming this work as research goes much further, because it does not only consist in the possibility of regulate new technologies but to create a new legal environment that every day becomes bigger and more important. The purpose of the present research is to demonstrate the usefulness of the Computer Law Chair and the importance of being constituted as an autonomous branch to which several writers intend to link it with other branches traditional law in general in order that computer law depend on its structure and regulation of other branches of law |
