Abstract: | Desde las atrocidades cometidas durante la Primera
y Segunda Guerra Mundial, surgió en la Comunidad
Internacional un compromiso con las generaciones
futuras de no repetir los horrores del pasado, y en su
virtud, se crearon los organismos internacionales
mundiales, como las Naciones Unidas, con la misión
principal de preservar la paz de la humanidad.
Con todo, desde entonces, más de 250 conflictos
armados han tenido lugar en todo el mundo,
caracterizados por la más amplia violación de los
derechos humanos y la impunidad de sus violadores.
Luego de 55 años, la Comunidad Internacional sigue
siendo prácticamente impotente para juzgar y castigar a
los responsables de estas atrocidades que desvirtúan el
principio de la paz mundial y el respeto a la persona
humana.
Si bien, esta demanda de justicia a lo largo de
estos años ha motivado la creación de cinco Comisiones
Internacionales de Investigación y de cuatro Tribunales
Internacionales ad hoc, su labor ha sido limitada, por
lo que sólo parcialmente han constituido mecanismos
para el establecimiento de responsabilidad penal y para
mantener el orden mundial y restaurar la paz. De todas
formas, la Justicia Penal Internacional no ha sido
mundial y estos organismos jurisdiccionales han
atendido casos específicos sin que su competencia se
extienda a otros casos igualmente graves como el de
Sierra Leona o Camboya. Cabe entonces preguntarnos,
hasta qué punto es posible hablar de una justicia
penal; hasta qué punto se ha ejercido una verdadera
jurisdicción internacional cuando está se ha
condicionado por razones de tiempo y espacio.
En este contexto, la creación de un Tribunal
Penal con Jurisdicción Internacional fue una aspiración
de la Comunidad Internacional por más de medio siglo.
En 1998, esta aspiración se vio concretada al aprobarse
en Roma, el Estatuto para la creación de la Corte Penal
Internacional.
Se ha afirmado, que este hecho, aparentemente
imperceptible para muchos, cambió por completo el
escenario mundial porque por un lado, resume y
sintetiza las expectativas de la Comunidad
Internacional, y por otro, cuestiona el poderlo de
gobiernos y gobernantes que hasta entonces se hablan
beneficiado de la impunidad que esta "laguna" legal e
institucional provocaba. Por esta misma razón, es que
la trascendencia del establecimiento de la Corte Penal
Internacional ha sido cuestionada, y no pocos afirman
que su presencia carece de la vinculación suficiente
que su naturaleza requiere y por tanto, aún no es
posible hablar de la existencia de una jurisdicción
penal internacional. It is therefore necessary to ask ourselves, to what extent is it possible to speak of justice penal; to what extent has a true international jurisdiction when it has been conditioned for reasons of time and space. In this context, the creation of a Court Criminal with International Jurisdiction was an aspiration of the International Community for more than half a century. In 1998, this aspiration was finalized upon approval in Rome, the Statute for the creation of the Criminal Court International. It has been asserted, that this fact, apparently imperceptible to many, completely changed the world stage because on the one hand, it sums up and synthesizes the expectations of the Community International, and on the other, questions the power of governments and rulers who until then speak benefited from the impunity that this legal "gap" institutional caused.
