Abstract: | La prisión preventiva en nuestro país, siempre ha generado un intenso debate por varios
factores como: ¿se violentan derechos humanos?; ¿es muy corto o muy prolongado el
tiempo de duración de la prisión preventiva?; ¿son correctas las reformas realizadas a
nuestra Constitución y Código de Procedimiento Penal, respecto a la prisión preventiva?.
Por tal razón se ha investigado ésta problemática de manera exhaustiva en el presente
trabajo, teniendo como respuesta que, la realidad socio-cultural de nuestro país, exige que
se aplique la prisión preventiva dentro de procesos penales, a fin de asegurar la presencia
del procesado en el proceso, como la de asegurar el cumplimiento de una posible pena; ya
que si no se la impondría, en muchos casos lastimosamente las personas procesadas no
comparecerían en el proceso, tal como sucede; es así que el Presidente Constitucional de la
República, vía Referéndum, consultará a los ciudadanos y ciudadanas del Ecuador, sobre
dos posibles reformas constitucionales referentes a la prisión preventiva, en la que se
plantea la no caducidad de la prisión preventiva en el caso de que la misma sea provocada
por el procesado; como también, en que casos procedería la sustitución de la prisión
preventiva por otras medidas cautelares de carácter personal. Preventive detention in our country has always generated an intense debate for several factors such as: are human rights violated? Is it too short or too long? length of time of pretrial detention? Are the reforms made to our Constitution and Code of Criminal Procedure, regarding pretrial detention ?. For this reason, this problem has been investigated exhaustively in the present work, having as an answer that, the socio-cultural reality of our country, demands that preventive detention is applied in criminal proceedings, in order to ensure the presence of the process in the process, such as ensuring compliance with a possible penalty; already that if he would not impose it, in many cases unfortunately the people who were prosecuted would not they would appear in the process, as it happens; it is so the Constitutional President of the Republic, via Referendum, will consult the citizens of Ecuador, about two possible constitutional reforms concerning pretrial detention, in which raises the non-expiration of preventive detention in the event that it is provoked by the defendant; as well as, in which cases would the substitution of the prison preventive by other precautionary measures of a personal nature.
