Abstract: | Es la privación de un bien jurídico que el poder público, a través de sus
instituciones impone a un individuo que ha cometido una acción u omisión
perturbadora del orden jurídico.
Al principio de la historia la pena fue el impulso de la defensa o de la
venganza, la consecuencia de un ataque injusto. Actualmente la pena ha pasado a ser
el medio con el que cuenta el Estado para preservar la estabilidad social.
El concepto de pena ha tenido varias definiciones. Para Raúl Carranca y
Trujillo; es: "un tratamiento que el Estado impone a un sujeto que ha cometido una
acción antisocial o que representa una peligrosidad social, pudiendo ser o no ser un
mal para el sujeto. It is the deprivation of a legal right that the public power, through its institutions imposes an individual who has committed an act or omission disturbing of the legal order. At the beginning of the story the penalty was the impulse of the defense or the revenge, the consequence of an unjust attack. Currently the penalty has become the means by which the State has to preserve social stability. The concept of punishment has had several definitions. For Raúl Carranca and Trujillo; is: "a treatment that the State imposes on a subject who has committed a antisocial action or that represents a social dangerousness, being able to be or not be a bad for the subject. |
