Abstract: | El presente trabajo de investigación responde a los siguientes cuestionamientos:
¿El comercio electrónico afecta de manera negativa el desarrollo del principio de la autonomía
de la voluntad privada? y¿es necesaria la creación de una entidad internacional que regule la
contratación electrónica internacional?.
La conclusión final de este trabajo es que el comercio electrónico y la autonomía de la voluntad
tienen un vinculo muy estrecho,el cual puede presentarse de diferentes maneras; sin que el
comercio electrónico interfiera con la autonomía de la voluntad o viceversa. Por otra parte, la
contratación electrónica tiene muy pocas regulaciones, por lo cual se vuelve necesaria la creación
de una entidad que defienda las garantías del consumidor y asegure el cumplimiento de las
formalidades de los contratos de adhesión.
Se realizó un análisis general del concepto deAutonomía de la Voluntad, conociendo cuáles son
los antecedentes, implicaciones y conceptos más importantes. También se hizo un estudio sobre
el comercio electrónico, medianteun análisis del mismo y su relación con los contratos de
adhesión y la autonomía de la voluntad, al igual que el proceso para contratarpor medios
informáticos y se proponela creación de una entidad que pueda mayor facilidad, efectividad y
sobretodo mayor seguridad para el consumidor. The present research work responds to the following questions: Does electronic commerce negatively affect the development of the principle of autonomy of the private will? and is it necessary to create an international entity to regulate the international electronic contracting ?. The final conclusion of this work is that electronic commerce and the autonomy of the will they have a very narrow link, which can be presented in different ways; without the Electronic commerce interferes with the autonomy of the will or vice versa. On the other hand, electronic contracting has very few regulations, which is why creation is necessary of an entity that defends consumer guarantees and ensures compliance with the formalities of the adhesion contracts. A general analysis of the concept of Autonomy of the Will was carried out, knowing which are the most important antecedents, implications and concepts. A study was also made on electronic commerce, through an analysis of it and its relationship with the contracts of accession and the autonomy of the will, as well as the process for contracting and the creation of an entity that can be easier, more effective and Above all, greater security for the consumer. |
