Abstract: | El panorama de la jurisdicción coactiva en el contexto ecuatoriano, ha
cobrado inusitada importancia, principalmente debido a tres factores convergentes (a
menudo análogos a los de otros países latinoamericanos): Primero, la generalización
de la modernización del Estado; segundo, las múltiples dificultades que el Estado ha
debido enfrentar para recuperar la cartera vencida de sus deudores; y finalmente, y
quizás el hecho de mayor impacto directo, es la problemática que planteó la quiebra
de la banca privada y la consecuente absorción de ese desfase por parte del Estado
para mantener la economía, tal como se aprecia en la Ley de Ordenamiento en
Materia Económica.
Es dentro de este escenario y bajo estas circunstancias particulares que nace
la AGD (Agencia de Garantía de Depósitos), con el propósito de garantizar la
devolución de los dineros de los usuarios de la banca privada. Ello explica, el
renovado auge que ha experimentado la jurisdicción coactiva, empleada como una
importante herramienta para la recuperación de los montos que se adeudan al Estado.
Ésta sería la causa fundamental que supone que la jurisdicción coactiva haya
extendido su marco jurídico y legal hasta prácticamente todas las Instituciones del
sector público, las cuales la han adoptado como el mecanismo idóneo para que a
través de ella se hagan cumplir las obligaciones pendientes. The panorama of coercive jurisdiction in the Ecuadorian context has unusually important, mainly due to three converging factors (a often analogous to those of other Latin American countries): First, generalization of the modernization of the State; second, the multiple difficulties that the State has due to face to recover the past due portfolio of its debtors; and finally, and perhaps the fact of greater direct impact, is the problem that raised the bankruptcy of private banking and the consequent absorption of that lag by the State to maintain the economy, as seen in the Law of Regulation in Economic Matter It is within this scenario and under these particular circumstances that it is born the AGD (Deposit Guarantee Agency), with the purpose of guaranteeing the refund of the money of the users of the private bank. This explains, the renewed boom that has experienced coercive jurisdiction, employed as a important tool for the recovery of the amounts owed to the State. This would be the fundamental cause that supposes that the coercive jurisdiction has extended its legal and legal framework to practically all the Institutions of the public sector, which have adopted it as the ideal mechanism for through it the pending obligations are enforced.
