La marca de certificación en el Ecuador. Sus posibles repercusiones en el público consumidor ecuatoriano

Abstract

La presente investigación tiene por objetivo el analizar a la marca de certificación y su registro, difusión y utilidad para el público consumidor. Iniciaremos realizando un breve resumen de la conformación de la Comunidad Andina de Naciones y sus funciones, dentro de ellas encontraremos la capacidad para emitir resoluciones y decisiones, dentro de ellas encontraremos la Decisión 486, haremos una breve reseña de las decisiones anteriores. La Decisión 486 trata del Régimen de la Propiedad Industrial, mismo que contiene a los Signos Distintivos, haré una introducción a los signos distintivos para llegar a la definición de la marca de certificación, su utilización y aprovechamiento en beneficio del público consumidor, para terminar hablaré del reglamento de uso y su respectiva funcionalidad dentro de cada marca de certificación.

The objective of this research is to analyze the certification mark and its registration, dissemination and utility for the consumer public. We will start by making a brief summary of the conformation of the Andean Community of Nations and its functions, within which we will find the capacity to issue resolutions and decisions, within which we will find Decision 486, we will make a brief review of the previous decisions. Decision 486 deals with the Industrial Property Regime, which contains the Distinctive Signs, I will introduce the distinctive signs to reach the definition of the certification mark, its use and exploitation for the benefit of the consuming public, to finish I will speak of the regulation of use and its respective functionality within each certification mark.
