"Óptica jurídica de seguridad y salud ocupacional en el Ecuador”

Abstract

El concepto de Seguridad y Salud Ocupacional, se ha ido gestando a través de la historia inicialmente en forma separada y sin correlación. Es así que desde la aparición de la Comunidad Primitiva, al haber diversificación en el ámbito laboral se delinean postulados incipientes en torno a la seguridad. En la Edad Antigua, se da un tratamiento a la salud pero desde el campo de la medicina, al ocuparse de las enfermedades de los esclavos, que eran quienes realizaban las labores productivas. En la Edad Media, mientras tanto, se inicia a tornear el derecho científico iniciando a esbozarse medicina de tinte ocupacional y el tratamiento de los accidentes de origen laboral por parte de las cofradías. Con la revolución industrial y la aparición del maquinismo se despliega movimientos intelectuales que protegen los principios fundamentales del hombre. Y se inicia la estratificación normativa, constitución doctrinaria de seguridad y salud ocupacional y la construcción de sistemas públicos encargados de absolver los innumerables temas que surgían al respecto.

Es así que en 1919 se crea la Organización Internacional del Trabajo, organismo encargado de establecer normativa legal y técnica sobre seguridad y salud ocupacional en el trabajo, normativas internacionales de las cuales Ecuador forma parte y en base de los cuales ha formulado su normativa interna de seguridad y salud ocupacional principalmente en el Código Laboral. Hoy en día se mira un desarrollo global en torno al tema e inclusive a nivel internacional la puesta en marcha de políticas y normas legales para la prevención de riesgos laborales y el mejoramiento del medio ambiente laboral se lo mira como una inversión por parte de los empresarios. En el Ecuador, hoy se desarrollan políticas públicas de difusión, implementación y mejoramiento del medio ambiente laboral y prevención de riesgos laborales ello concatenado con el Neoconstitucionalismo del cual formamos parte.

Today a global development is seen around the issue and even internationally the implementation of policies and legal standards for the prevention of occupational hazards and the improvement of the working environment is seen as an investment by employers . In Ecuador, public policies are currently being developed to disseminate, implement and improve the work environment and prevent occupational hazards linked to the Neo-constitutionalism of which we are a part.
