Resumen : | Dentro del conjunto de redes informáticas conocidas como la Internet, el Derecho de Autor enfrenta un peligro latente de vulneración de los derechos y garantías inherentes a él, tales como su autoría y exclusividad de explotación. Al respecto, la Ley de Propiedad Intelectual del Ecuador, no prevé la posible vulneración y peor aún, el castigo del cual serian sujetos los infractores de los Derechos de Autor a través de medios telemáticos en la Web
Este hecho deviene en una suerte de autorregulación por parte de la Internet y principalmente por parte de sus usuarios. En la actualidad existen varios programas o software destinados a proteger la información y los derechos que sobre derivados de ella. Esta iniciativa ha venido creciendo frente a la imposibilidad de contar con una viabilidad jurídica, eficaz, efectiva y de directa aplicación, con relación a los conflictos que puedan generarse en el ámbito de la Propiedad Intelectual.
Es preocupante la indefensión a la cual están sujetos los distintos autores e intérpretes en sí, todos aquellos que han plasmado su ingenio y personalidad en una obra; sus creaciones están notoriamente expuestas a un sinnúmero de vulneraciones de carácter autoral, dentro de la inmensa plataforma tecnológica que constituyen la Internet.
Si bien es cierto existen varios tratados internacionales que recogen garantías otorgadas para la protección de los Derechos de Autor, también es cierto que gracias a la globalización y a la evolución de la dinámica informática y comercial, existe gran confusión e inaplicabilidad de Ley frente a una vulneración concreta. Within the set of computer networks known as the Internet, the Copyright Law faces a latent danger of violation of the rights and guarantees inherent in it, such as its authorship and exploitation exclusivity. In this regard, the Law of Intellectual Property of Ecuador, does not foresee the possible violation and even worse, the punishment of which would be subject the infringers of the Copyright through telematic means in the Web This fact becomes a kind of self-regulation by the Internet and mainly by its users. Currently there are several programs or software designed to protect information and rights that derive from it. This initiative has been growing in the face of the impossibility of having a legal viability, effective, effective and direct application, in relation to conflicts that may arise in the field of Intellectual Property.
