Reformas a la ley de extranjería y a su reglamento respecto a las visas de inmigrantes en Ecuador otorgadas por la dirección general de extranjería

Abstract

La razón que origina la realización del presente trabajo doctoral, parte de la hipótesis de si es necesario reformar a Ley de Extranjería, respecto a las visas de inmigrantes en el Ecuador, debido a los factores que vamos a esbozar en el trascurso de esta investigación y así poder plantear reformas de acuerdo a la Constitución Política del Ecuador vigente. Para el efecto pondremos a consideración una introducción al trabajo, que nos aproxime al tema a tratarse. A lo largo de la historia de la humanidad, la migración ha sido un fenómeno constante, grupos humanos se han desplazado por todos los confines del mundo, los motivos y fines los más diversos, desde la búsqueda incansable del lugar ideal para que los acojan, les brinde el alimento y se reproduzcan; hasta las migraciones obligadas por la inclemencia del tiempo y más tarde por la lucha y conquistas de los sitios ocupados por una comunidad y despojados por otros para su ocupación. Ya en tiempos modernos, diversos siguen siendo los motivos para que las poblaciones migren; por ejemplo, guerras, desastres naturales, sobrepoblación, pobreza, ausencia de empleo, etc. o solo el instinto humano de desplazarse por el mundo, con todo el derecho que la naturaleza le ha otorgado, al fin de cuentas el hombre es heredero de la tierra por derecho natural. Hoy los motivos han variado, entre los que encontramos, la tan mencionada globalización, las luchas políticas, la violencia, entre otros. En fin cualquiera que sea la causa no hay duda de que el fenómeno de la migración ha sido un tema constante en las políticas de los gobiernos, tanto de los países que reciben inmigrantes como los que originan emigrantes.

The reason for the completion of the present doctoral work, part of the hypothesis of whether it is necessary to reform the Immigration Law, regarding immigrant visas in Ecuador, due to the factors that we are going to outline in the course of this investigation and thus be able to propose reforms according to the Political Constitution of Ecuador in force. For this purpose we will consider an introduction to the work, which brings us closer to the topic to be discussed. Throughout the history of humanity, migration has been a constant phenomenon, human groups have moved to all corners of the world, the motives and ends the most diverse, from the tireless search for the ideal place to be welcomed, give them food and reproduce; even the migrations forced by the inclemency of the time and later by the fight and conquests of the sites occupied by a community and deprived by others for their occupation. Already in modern times, diverse are still the reasons for populations to migrate; for example, wars, natural disasters, overpopulation, poverty, absence of employment, etc. or only the human instinct to move around the world, with all the rights that nature has granted, in the end, man is the heir of the earth by natural right. Today the reasons have varied, among which we find, the much-mentioned globalization, political struggles, violence, among others. In short, whatever the cause, there is no doubt that the phenomenon of migration has been a constant theme in the policies of governments, both in countries that receive immigrants and those that originate emigrants.
