The international sale through its economic, strategic and political validity has not had the due legal justification that the foundation can be seen in terms of its formation, acceptance of merchandise, price fixing, risk, and mainly in relation to breaches and claims that may lead to the payment of damages, interests, termination of the contract ect. This activity has been regulated by multiple sources such as customary, arbitral, conventional, which together make up the so-called principles of international trade. These are not universally accepted since the legal principles of foreign trade do not form part of the internal legislations, or these in turn are incompatible because they are inspired by different principles of international law or generally accepted uses in this regard. Through international treaties it is tried to provide legal guidelines that allow the development and efficiency of this activity. At present, there are new contractual forms influenced by the advancement of technology and the coexistence of different legal systems. |
