La invención patentable

Abstract

Con el tema propuesto se determinó el origen de las invenciones patentables, se destacó el desarrollo evolutivo de la antedicha figura dentro del País y en la Comunidad Andina de Naciones. Además, se definió a las invenciones patentables y se desentrañó su naturaleza jurídica. Por otro lado, se dilucido el contenido y naturaleza de las excepciones, exclusiones y condiciones positivas de patentabilidad. Por último, como tema medular, se demostró que si se suscribe el Tratado de Libre Comercio TLC existirían graves contradicciones legislativas, las cuales podrían ser solventadas en atención a las sugerencias que el compareciente planteó a lo largo de este trabajo académico.

With the proposed topic the origin of the patentable inventions was determined, the evolutionary development of the aforesaid figure within the Country and in the Andean Community of Nations was highlighted. In addition, patentable inventions were defined and their legal nature was unraveled. On the other hand, the content and nature of the exceptions, exclusions and positive conditions of patentability were clarified. Finally, as a core issue, it was demonstrated that if the Free Trade Agreement was signed, there would be serious legislative contradictions, which could be solved in response to the suggestions that the respondent raised throughout this academic work.
