Abstract: El presente trabajo de investigación tiene como objetivo estudiar el reconocimiento a la doble filiación materna para los hijos concebidos por métodos de reproducción asistida dentro de la unión de hecho en el Ecuador. Para hacerlo, hemos dividido la investigación en tres capítulos, dentro de los cuales analizaremos la familia, la homosexualidad y la filiación. Analizando los nuevos conceptos de voluntad procreacional y socioafectividad. El enfoque utilizado para hacerlo es epistemológico, explorativo y descriptivo. La investigación permite concluir que la familia no es una institución estática; que la homosexualidad no se constituye como una inhabilitante para acceder a la paternidad; que nuestras leyes se han visto rebasadas por el campo biotecnológico, especialmente en el ámbito del derecho de familia; y, que los legisladores ecuatorianos deben tomar la batuta en la reforma de la rama antes mencionada.
The objective of this research work is to study the recognition of double maternal filiation for children conceived by assisted reproduction methods within of the de facto union in Ecuador. To do this, we have divided the research into three chapters, within which we will analyze the family, homosexuality and filiation. Analyzing the new concepts of procreational will and socio-affectivity. Focus used to do it is epistemological, explorative and descriptive. The investigation allows conclude that the family is not a static institution; that homosexuality is not constituted as an inability to access paternity; that our laws have been exceeded for the biotechnological field, especially in the field of family law; and, that the Ecuadorian lawmakers should take the lead in reforming the aforementioned branch.
