Aplicación de la informática jurídica en el actual sistema legal ecuatoriano

Abstract

En la actualidad, el desarrollo de la tecnología, y específicamente de la informática, han alcanzado un nivel nunca antes imaginado. Es importante anotar, que el avance vertiginoso del Internet ha provocado que, tanto personas naturales como jurídicas caminen de la mano con la tecnología, siendo en este momento una herramienta importante dentro del quehacer jurídico.

En tal virtud, el Internet ha logrado una revolución en las comunicaciones, pues gracias al espacio que este medio brinda, las relaciones se han fortalecido, es por esto que por ejemplo los productos y servicios de una empresa o de un particular pueden ser ofrecidos a través de una página web y vendidos de la misma forma, a un precio económico y a tiempo inmediato.

El actual sistema legal ecuatoriano, si bien es cierto ha realizado esfuerzos válidos para de alguna forma agilitar su tarea y brindar mejores y más eficientes servicios; sin embargo, todavía presenta varias trabas y dificultades en muchas de sus actividades, que retardan el trabajo de los funcionarios públicos, abogados en libre ejercicio y usuarios en general.

En varios países de Latinoamérica se vienen implementando, desde hace algunos años, las herramientas que brinda la Informática Jurídica. Es así, que en muchos servicios públicos los usuarios pueden gestionar a través de redes, la solicitud de certificados, la inscripción de derechos en Registros Públicos, licencias administrativas, realizar las declaraciones tributarias o incluso presentar cualquier escrito en los juzgados y recibir notificaciones de los mismos.

A lo largo de este trabajo investigativo se pretende, en un principio detallar y analizar las herramientas que ofrece la Informática Jurídica, de manera que se especifiquen los medios a través de los cuales se pueden alcanzar estas herramientas, para luego establecer la importancia y el beneficio que su aplicación aportaría al actual Sistema Legal Ecuatoriano.

Para el desarrollo de este trabajo será necesario comenzar describiendo brevemente el concepto y la historia de los instrumentos fundamentales de la Informática Jurídica: el computador y el internet. Luego de ello podremos recabar en la definición y las características del Comercio Electrónico.

Con esta información podremos ya establecer claramente ¿qué es la Informática Jurídica?, para esto explicaremos sus características, clasificación y aplicación. Luego de esto analizaremos a los Documentos Electrónicos, la Firma Electrónica y las Entidades de Certificación y Registro, componentes muy importantes dentro de los instrumentos informáticos.

Finalmente y echando mano de toda la información descrita anteriormente, podremos establecer claramente ¿cuáles son las falencias del actual Sistema Legal Ecuatoriano? y, lo más importante, ¿cómo las herramientas de la Informática Jurídica pueden ayudar a mejorar nuestro sistema legal?, para esto deberemos puntualizar casos prácticos y también referirnos a la labor que realizan otros países, más desarrollados en esta materia.

Currently, the development of technology, and specifically of information technology, have reached a level never before imagined. It is important to note that the vertiginous advance of the Internet has caused both natural and legal persons to walk hand in hand with technology, being at this time an important tool in the legal field.

In this virtue, the Internet has achieved a revolution in communications, because thanks to the space that this medium provides, relations have been strengthened, which is why, for example, the products and services of a company or a private individual can be offered to through a web page and sold in the same way, at an economical price and in an immediate time.

The current Ecuadorian legal system, although it is true, has made valid efforts to in some way streamline its task and provide better and more efficient services; However, it still presents several obstacles and difficulties in many of its activities, which delay the work of public officials, freelance lawyers and users in general.

In several Latin American countries, the tools provided by Legal Information Technology have been implemented for some years now. Thus, in many public services users can manage through networks, the request for certificates, the registration of rights in Public Records, administrative licenses, make tax returns or even submit any writing in court and receive notifications from the same.

Throughout this research work is intended, at first to detail and analyze the tools offered by the Legal Information, so as to specify the means through which these tools can be achieved, to then establish the importance and benefit that its application would contribute to the current Ecuadorian Legal System.

For the development of this work it will be necessary to begin by briefly describing the concept and the history of the fundamental instruments of the Legal Informatics: the computer and the internet. After that we can collect the definition and characteristics of Electronic Commerce.

With this information we can already establish clearly what is the Legal Information, for this we will explain its characteristics, classification and application. After this we will analyze the Electronic Documents, the Electronic Signature and the Certification and Registration Entities, very important components within the computer tools.

Finally and using all the information described above, we can clearly establish what are the shortcomings of the current Ecuadorian Legal System? and, most importantly, how can the tools of Legal Information Technology help to improve our legal system? For this we must point out practical cases and also refer to the work done by other countries, more developed in this area.
