Title: La falta de límites a la autonomía universitaria

Abstract: Desde hace algún tiempo, con un vigor nunca conocido, nuestras instituciones reivindican la autonomía universitaria, como si hubieran, sido fecundadas durante estos últimos años por la idea autonomista, enmarcada en una Ley Orgánica de Educación Superior que contiene un enunciado de propósitos, más que otra cosa, porque, como es sabido y trataremos de explicitar aquí, la intencionalidad de la Ley se ha concretado en bien poco, por no decir en nada. La construcción del concepto de autonomía se ha caracterizado por una complejidad, derivada, de una parte, por su confusión con el concepto de autarquía, como por su explicación aparentemente distinta en ámbitos diferenciados, su extensión y todos sus componentes hacen que su aplicación sea malentendida, concibiéndola como una potestad magnífica para las autoridades universitarias, que les concede la facultad de transgredir el ordenamiento jurídico imperante en la legislación universitaria, con el pretexto de una amplísima gama de poderes que una autonomía puramente ideal les otorga. La autonomía implica, simultáneamente, grave responsabilidad ante el presente y ante la historia, ante la democracia y ante la cultura. El concepto de autonomía no es sinónimo de perfección y de infalibilidad. La autonomía permite la autoreflexión sobre las propias faltas y conduce al retorno de la normalidad institucional dentro de una dinámica de alta y superada conciencia. La lucha por el mantenimiento y superación de la autonomía universitaria puede equipararse tan sólo al incesante batallar de los pueblos por las libertades, frente a la exageración del poder público. En este trabajo, titulado “La Falta de Límites a la Autonomía Universitaria”, abordaré la problemática que la autonomía universitaria ha generado para todo aquel que se encuentra afectado a ella, estudiantes, docentes e inclusive los mismos órganos de control que parecen supeditadas a una falta de límites visibles al concepto de autonomía, partiendo de una visión global de su concepto, de su evolución y aplicabilidad en las universidades de Europa y América Latina a lo largo del tiempo y finalmente de su real repercusión en la administración del Sistema de Educación Superior ecuatoriano, desde un análisis cronológico de la normativa que ha regido en el Ecuador y sobre las nuevas disposiciones que el régimen actual pretende imponer sobre la universidad ecuatoriana y más precisamente sobre el principio de autonomía universitaria. Finalmente, y ante la opción de una nueva legislación universitaria, he incluido conceptos básicos y mínimos que deberían constar en la nueva Ley de Educación Superior, incluyendo aspectos sobre su conformación, órganos reguladores e inclusive políticas que podrían aplicarse. Todo buscando aportar a un retrógrado y arcaico principio de autonomía universitaria ilimitada, que no conoce de barrera jurídica alguna y que convierte a las universidades en reductos impenetrables e infranqueables, con serias consecuencias para la vida académica y profesional de quienes acudimos a ellos.
For some time, with a vigor never known, our institutions claim university autonomy, as if they had, been fertilized during these last years by the autonomist idea, framed in an Organic Law of Higher Education that contains a statement of purposes, rather than otherwise, because, as is known and we will try to make explicit here, the intentionality of the Law has materialized in very little, to say nothing. The construction of the concept of autonomy has been characterized by a complexity, derived, on the one hand, by its confusion with the concept of autarky, as by its apparently different explanation in differentiated areas, its extension and all its components make its application misunderstood , conceiving it as a magnificent power for the university authorities, which grants them the faculty to transgress the prevailing legal order in the university legislation, under the pretext of a very wide range of powers that a purely ideal autonomy grants them. Autonomy implies, simultaneously, serious responsibility before the present and before history, before democracy and before culture. The concept of autonomy is not synonymous with perfection and infallibility. Autonomy allows self-reflection on one's own faults and leads to the return of institutional normality within a dynamic of high and surpassed consciousness. The struggle for the maintenance and overcoming of university autonomy can be compared only to the incessant struggle of the people for freedom, against the exaggeration of public power. In this work, entitled "Lack of Limits to University Autonomy", I will address the problems that university autonomy has generated for everyone who is affected by it, students, teachers and even the same control bodies that seem to be subject to a lack of visible limits to the concept of autonomy, based on a global vision of its concept, its evolution and applicability in the universities of Europe and Latin America over time and finally its real impact on the administration of the Higher Education System Ecuadorian, from a chronological analysis of the regulations that have governed in Ecuador and the new provisions that the current regime seeks to impose on the Ecuadorian university and more precisely on the principle of university autonomy. Finally, and before the option of a new university legislation, I have included basic and minimum concepts that should be included in the new Higher Education Law, including aspects on its formation, regulatory bodies and even policies that could be applied. All seeking to contribute to a retrograde and archaic principle of unlimited university autonomy, which does not know of any legal barrier and that turns universities into impenetrable and impassable redoubts, with serious consequences for the academic and professional life of those who attend them.
