Abstract: Los mandatos Constituyentes, que legislan sobre temas que no trascienden en el pleno y efectivo desempeño de los plenos poderes, ostentan la flagrante violación al principio jurídico que “en derecho las cosas se deshacen como se hacen”, en concordancia con lo manifestado, en el artículo número dos del mandato constituyente número uno, se señalan como Atribuciones de la Asamblea Constituyente: La expedición de mandatos constituyentes, leyes, acuerdos, resoluciones y las demás decisiones que adopte en uso de sus atribuciones. Tales decisiones, tienen la característica de ser jerárquicamente superiores a cualquier otra norma del orden jurídico y de obligatorio cumplimiento para todas las personas naturales, jurídicas y demás poderes públicos sin excepción alguna. La naturaleza de los Mandatos Constituyentes, les permitía ser decisiones y normas expedidas por la Asamblea Constituyente, para el ejercicio de sus plenos poderes, los mismos que tienen su vigencia, ligada al funcionamiento de la Asamblea, y no debían ser utilizados para regular temas que corresponden al dictado o reformas de leyes, cuya vigencia es indefinida. En virtud de las consideraciones expuestas, debemos manifestar que al utilizar los Mandatos Constituyentes para reformar las leyes ordinarias, indiscutiblemente la Asamblea Constituyente cometió un error técnico, lo que nos lleva al hecho inconcebible que esas reformas legales que se introducen vía mandatos son inderogables y atentan contra el orden, la lógica jurídica. Es necesario recordar que el Tribunal Constitucional, hoy Corte Constitucional no podrá suspender total o parcialmente los efectos de dichos Mandatos Constituyentes, aún si los mismos no fueran en beneficio de la sociedad ecuatoriana, ya que juzgar la constitucionalidad de este tipo de actos normativos no está expresamente consignado entre sus competencias constitucionales o legales por lo cual en el evento de ser indispensable reformar un mandato no existirá una fórmula jurídica y una vez más se deberá romper el órden jurídico y dar una solución política a este tema.
Constituent mandates, which legislate on issues that do not transcend the full and effective performance of full powers, flagrantly violate the legal principle that "in law things are undone as they are", in accordance with the manifested, in the Article number two of the constituent mandate number one, are indicated as Attributions of the Constituent Assembly: The issuance of constituent mandates, laws, agreements, resolutions and other decisions adopted in use of its powers. Such decisions have the characteristic of being hierarchically superior to any other rule of the legal order and of obligatory compliance for all natural persons, legal entities and other public authorities without exception. The nature of the Constituent Mandates allowed them to be decisions and norms issued by the Constituent Assembly, for the exercise of their full powers, which are valid, linked to the functioning of the Assembly, and should not be used to regulate issues that they correspond to the dictation or reforms of laws, whose validity is indefinite. By virtue of the above considerations, we must state that when using the Constituent Mandates to reform the ordinary laws, the Constituent Assembly unquestionably committed a technical error, which leads us to the inconceivable fact that these legal reforms that are introduced through mandates are non-derogable and undermine against the order, the legal logic. It is necessary to remember that the Constitutional Court, today Constitutional Court can not suspend all or part of the effects of these Constituent Mandates, even if they were not for the benefit of Ecuadorian society, since judging the constitutionality of this type of normative acts is not expressly consigned between its constitutional or legal powers so that in the event of being indispensable to reform a mandate there will be no legal formula and once again the legal order must be broken and a political solution to this issue.
