dc.description.abstractEn estos tiempos de reformas sociales, económicas, culturales, pero también legales, que han tenido como objeto transformar esa realidad histórica y excluyente con las grandes mayorías sociales, haciendo de un Estado ineficiente y ausente en un Estado democrático, participativo, plural, garantista, eficaz; proceso sin duda complejo en el cual era necesario implementar cambios profundos en nuestra legislación que permitieran concretar los ideales de aquel nuevo Estado; no obstante en ese transcurso de cambios todavía podemos ver que algunas leyes y figuras jurídicas se contraponen con el espíritu mismo que inspiró esta transformación, por esta razón es preciso analizar y debatir la vigencia de instituciones legales heredadas que ponen en peligro aquel Estado democrático que se constituye como protector de los derechos y la justicia; bajo ese contexto he creído pertinente realizar una investigación sobre la prisión preventiva, aquella medida cautelar que priva de la libertad a un sujeto imputado como autor o cómplice de un delito de acción pública sancionado con pena mayor a 1 año y del cual se sospecha que puede provocar actos que perjudiquen la realización del proceso penal. Dicha medida a lo largo de la historia ha sido causante de diversas arbitrariedades por parte del Estado, puesto que de por sí constituye una contradicción someter a prisión a una persona que no ha sido declarada culpable del delito que se le imputa, es decir, al procesado se le quita un derecho sin que de por medio exista un juicio y una sentencia condenatoria, único documento que habilita la pérdida de derechos. A esto hay que sumarle el tiempo excesivo de duración de esta medida, la falta de motivación para poder establecerla, la poca VIII utilización de las demás medidas no privativas de libertad, todo este conjunto de circunstancias hacen hoy en día que la prisión preventiva constituya el problema central del derecho procesal penal con relación al derecho constitucional. ¿Se puede justificar la privación de libertad solamente para garantizar fines procesales? El proceso penal tiene que regirse por las disposiciones determinadas en la Constitución de la República y en los tratados internacionales de derechos humanos, estos instrumentos ciertamente reconocen a la prisión preventiva como medida cautelar, pero a su vez establecen principios que regulan su imposición. El debido proceso, la presunción de inocencia, la proporcionalidad, la excepcionalidad de la privación de libertad, el principio de jurisdiccionalidad, la mínima intervención penal, son algunas de las normas que limitan el uso de esta medida cautelar, sin embargo la prisión procesal en nuestro sistema constituye la regla general del proceso, ante lo cual se genera una oposición de conceptos y un quebrantamiento a las disposiciones de mayor jerarquía. En este trabajo he querido establecer una discusión normativa, fáctica y dogmática, con el fin de determinar si la prisión preventiva aún se puede justificar bajo el amparo de un Estado de Derechos y Justicia que se encuentra respaldado en una Constitución de la República garantista y de vanguardia, o si simplemente esta institución ha caducado y su reconocimiento vulnera los ideales alcanzados por las reformas legales implementadas.-
dc.description.abstractIn these times of social, economic, cultural, but also legal reforms, that have been aimed at transforming that historical and excluding reality with the large social majorities, making an inefficient State and absent in a democratic State, participatory, plural, guarantor, effective; certainly complex process in which it was necessary implement profound changes in our legislation that would allow us to achieve the ideals of that new State; However, in this course of changes we can still see that some laws and juridical figures are opposed to the very spirit that inspired this transformation, for this reason it is necessary to analyze and debate the validity of institutions inherited laws that endanger that democratic state that is constituted as protector of rights and justice; In that context, I thought it was pertinent to carry out a investigation on preventive detention, that precautionary measure that deprives the freedom to a person accused as an author or accomplice of a crime of public action sanctioned with more than one year and which is suspected of causing acts that harm the completion of the criminal process. This measure throughout history has been the cause of various arbitrariness on the part of of the State, since it is in itself a contradiction to submit a person to prison person who has not been found guilty of the crime that is imputed to him, that is, the defendant a right is taken away from him without there being a trial and a condemnatory sentence, only document that enables the loss of rights. To this we must add the time excessive duration of this measure, the lack of motivation to establish it, little VIII use of other non-custodial measures, this whole set of circumstances today make preventive detention the central problem of the criminal procedural law in relation to constitutional law. Can deprivation of liberty be justified only to guarantee procedural ends? The criminal process has to be governed by the provisions determined in the Constitution of the Republic and in international human rights treaties, these instruments they certainly recognize pretrial detention as a precautionary measure, but in turn they establish principles that regulate their imposition. Due process, the presumption of innocence, proportionality, the exceptionality of the deprivation of liberty, the principle of jurisdictionality, the minimum penal intervention, are some of the norms that limit the use of this precautionary measure, however the procedural prison in our system constitutes the general rule of the process, before which an opposition of concepts and a breach of the highest hierarchy. In this paper I wanted to establish a normative, factual and dogmatic discussion, with the In order to determine whether pretrial detention can still be justified under the protection of a State of Rights and Justice that is backed by a Constitution of the Guaranteed and vanguard Republic, or if this institution has simply expired and its recognition violates the ideals achieved by the legal reforms implemented.-
