dc.descriptionForced assignments in Ecuador, without a doubt, are exclusive formalities of wills, which evidently oppose the right to freedom to testate that testators have, it is worth mentioning that these limitations on the freedom to testate counteract that the will is expressed in the will of the testator, which generates a legal problem that is intended to be resolved with the course of this investigation. In order to provide a proposal for a solution to this problem, what is mentioned in other legislations of our region and the world will be taken into account, in addition to the different statements of various authors specialized in inheritance law.es
dc.description.abstractLas asignaciones forzosas en Ecuador, sin duda alguna son formalidades exclusivas de los testamentos, que evidentemente contraponen el derecho a la libertad de testar que tienen los testadores, cabe mencionar que estas limitaciones a la libertad de testar contrarrestan que en el testamento se exprese la voluntad del testador, lo que genera un problema jurídico que se pretende resolver con el transcurso de la presente investigación. Para poder brindar una propuesta de solución a este problema, se tomarán en cuenta lo mencionado en otras legislaciones de nuestra región y del mundo, además de las distintas afirmaciones de varios autores especialistas en derecho sucesorio.es
